The company I have worked the last 6 years for has recently changed the manner in which the drivers are paid. We were always paid mileage & stop pay, but now the company wants to pay us a flat salary with no additional compensation for extra work. It ends up being a pay cut of about 20% on average. My question is, is this legal & do the drivers have any rights in this matter?

A local attorney and maybe your state labor board is where to ask.

Nope you have nothing, they can do anything they want and all you can do is find another job. A place I worked changed the pay structure 5 times or so in 3 years, every time I figured out how to maximize it they would change it again.

Even if you had an option other then quitting do you really want to work for an outfit that pulls that kind of crap?

You could unionize but that's a whole different topic.

The real question here is, Are you willing to accept it?

No company can force you to do anything. But ANY company can change the way/method of payment at will. Provided it does not break existing laws and/or contracts.

I'm willing to bail over 5% cut in pay. A 20% cut would have them calling to see why a driver didn't show up and nobody answering the phone.

Without a union contract...they can do whatever they wish.

Thanks for the responses. I was skeptical about any avenues we could pursue, but I don't want to go quietly.

Well if your going to you might as well make a good show. You've got 6 years so don't mess up the reference. A call to the union for some ideas might be fun, if they come knocking that will get some attention. In fact that's a good way to make some waves.

How about manning up and talking to management, instead of calling somebody else to do your fighting for you.

Management isn't stupid when it comes to drivers pay. They already messed him around and they know it. What makes you think talking will do anything? If it where me I'd rather just go talk to my dog, I'm pretty sure I'd get better results.
