Damaged Trailer by forklift operator.

    my van was damaged by the forklift driver dropping a reel of wire and receiver wants to pay for repairs out of pocket. Thinks it is a minimal repairs it is a brand new trailer so explained it wouldn’t be a patch job it will be repaired to be as trailer was before incident. I also requested compensation for my lost revenue for the rest of the week when trailer can be repaired. Is that unreasonable? They acted like I was crazy... but why should I be punished for your neglect... the forklift driver told me this happens all the time and they just don’t want to figure out a new way to unload the reels but it typically happens to their company owned trailers so they just swap them out until they can be repaired.

    Seems reasonable. They just don’t want to pay more than they absolutely have to.

    Get a repair estimate, then put together an invoice with your lost revenue. Be fair and reasonable about the money, also be ready to back up the numbers.
    Submit the invoice with a to be paid date, then follow up on it.

    Get an estimate. And they won’t pay more then what it costs to rent a trailer for a week.

    Tell them if you can borrow one of their trailers while they fix yours. :D

    No not at all unreasonable, they have to deal with all of it. If it is a new trailer, document everything that they did without moving the truck out of the dock, pictures, who you talked to and so on. Then take the trailer to authorized repair center for an estimate, and send a copy to the company and tell them to send the trailer company a check.

    I would notify my insurance agent.
    Your new trailer, now old. Can you tell if the beams are still true.
    You don't say how heavy the reel is. What damage is done. Sidewall buckled? Did the Sidewall move the roof.
    Floor buckled. Beams bent.
    Until you have a shop evaluate, You don't know the extent of the damage.

    PS. as noted in previous post. Make notes of all that was said and by whom.
    And you can never take too many pictures.

    My company charges for trailer damage..
    IE : Miller brewing
    Con agra
    Benton Dickinson
    Tyson
    Etc
    Always amazed how shippers and receivers view a 70k trailer as something they beat the piss out of .
