Do I have to split?

    I'm out of hours (14) in dock. Finally empty and I must leave the receiver's property. I have been there for 8 hours. Can I PC to a truck stop (one mile away) or do I have to split, start my clock, to get there? I do have drive time with a split.

    I would PC to the truck stop, but that’s just me!

    IF you've run off your 14hrs a split does no good. Nothing to get back at the end of 8. PC to the truck stop to keep the off duty going (assuming you were off duty at the dock waiting for the unload), switch back to off duty-no pc and wait for a total of 10 accumulated and you're fresh.

    Well I docked with 6 hours left and went into the berth. My 14 then expired 6 hours later but I could split to get those 6 hours back. But do I have to?

    DOT regs basically say we can PC if out of hours at a shipper/receiver to the nearest parking. My concern is if DOT questions my PC use could they say I should have split before using PC.

    True. In this situation a split really wouldn't have hurt me. But if I had run out of hours and had been in the berth/off dury say for 5 hours then I would have to do 7 hours in the berth to complete the split, a 12 hour break basically.

    I guess my question is can drivers be forced to split or can we strictly stay on a 14 on/10 off schedule..

    Not exactly having to do with the OP but close.

    I was told, or read somewhere, that if you are at a shipper or receiver and are out of drive time and must leave, you can PC out but when you do, your 10 hour break restarts when you finally get parked where you can sit for 10 hours. I was told you can't wait 5 hours, PC for 2 hours to parking, wait 3 and be gone fresh. Doesn't work that way. Or so I was told.

    5 hours off would only count as 3 so you'd still have to do 7 hours sleeper to complete.
    Nobody can force you to use split. It's an option. You can stick with 10 hour breaks if you want. I know drivers who won't go anywhere near the split option because they're worried they'll get it wrong and flag a violation. Company is totally cool with it.
