Doesnt matter if you were out of hours or not. The FMCSR specifically ALLOWS you to move on PC from a shipper/receiver. They KNOW shippers/receivers dont always have room or just plain allow drivers to finish their time on site. PC is "off duty" time. The only thing it might do is screw up your sleeper berth time if you happened to be on that line at the time and are doing a split. And if thats the case, there is nothing you can do about that.

You will note on line 3 of allowed you can move to nearest safe place. No mention of if you are out of hours or not... -

That link on first glance implies one has to be out of hours to PC from a shipper/receiver, but based on the previous link posted it appears it isn't necessary to be out of hours to PC from a shipper/receivercatdog45 Thanks this. -
