Well right is right, and wrong is wrong. If it's in the regulation book, I will uphold it. But I'm not making sheet up for anyone. In the end it is my name that is on that report. My name the complaint comes in on, and dang it I get a few a year. Seems some just can't stand the truth. My problem is when the driver, or anyone for that matter, acts like a jack a_s_s I have no problem of telling them where the bear s_hits. Anyway I have heard of this before, when MN was in the initial stages of validating their study. I just didn't realize they were actually using it in enforcement scenarios.

I don't know much about OOIDA, but I do know that when you write your state representatives you are more likely to get something done. They look at some of these organizations as a company. They don't see the many people behind it no matter how many times they tell them. But as soon as they start recieving individual letters from each of these people, it starts to add up and they can get a more tangible idea of what their voters are thinking. I believe I have written e-mails to my representatives at least 25 times just this year on a lot of issues. That's what they are there for, write em up.
RonRickG Thanks this. -
I think it would take more than that. After all common sense does come into play here. If you logbook looks like it might have been forged then I can see the list as a tool.
Maybe since I'll hauling over 12,000 gallons of gasoline I don't want any driver going to sleep on me and running into me. Sorry but I'll drive what the law says I can and I'll stay a relaxed driver. -
I guess representatives dont even listen to any unions or the ATA then. Just because your a member of a union or OOIDA dosent mean not to take it upone your self to write your congressmen.
-
If it was ment as sarcasm I'm sorry that I didnt take it that way. But reading it the way you posted and reading the part on the servey where the driver is to rate there own fatigue level it looked like you and many others (and myself) that 10 check marks and you would be put out of service.

ATA doesn't get what they want either . They didn't get the guest worker program , oversize trucks, or speed limiters . The trucking industry has very little influence . Unions ? Big joke . What has been done for them ? Obama wants to save $9 billion by cutting postal workers benefits . He shafted several unions by scrapping the "Buy American plan .
Watch what happens to Chrysler and GM workers . -
I hear you. And I understand your thinking on this. I wouldn't want to be put in the position to evaluate drivers like that either. And I agree with your statement about having an 8 hour class to become an expert on judging these situations. Like you said, its your reputation behind the decision. I won't disagree with you on the A_holes either, ### they are EVERYWHERE. LOL I was taught to respect people of authority, and believe that many people have either forgotten that or decided it wasn't worth it.

The whole thing is full of holes, and I see major problems by them instituting this into the regulations.

Sorry to get off topic, but I have to respond to this one!
GOVERNMENT REGULATION IS THE CAUSE OF THIS MELTDOWN!!!!
The community redevelopment act or whatever it is called is the cause of the housing crisis which is at the root of the financial crisis. Started by Carter, expanded by Clinton and defended by Dodd and Barney Frank.
They FORCED private banking institutions to make questionable loans to low income people even if they had poor credit. When the rates changed(went up) these institutions took the hit (along with the crooked Fannie May and Freddie Mac).
The banks were in between a rock and a hard place. Make the shakey loans and avoid gov't penalties or make loans based on sound financial reasoning and get harassed by ACORN and the government.
Regulations made by politicians who generally have no business experience, generally do much more harm than good. The housing, financial, and automotive crisis we are in right now should be laid in the lap of politicians and the ridiculous regulations they have passed.
Anyone who gets their news outside of the very biased AP, MSNBC, ABC, NBC, CBS, NYT, etc. would understnd this. -
I understand that, however, this is being used to ask drivers questions. Well now when you answer the questions on here to the DOT person, you are telling them you have a TV...etc. There are check marks on the page to check off how you answer. Its a list used to 'determine fatigue,'...and when you finish the survey, they can then determine how fatigued you are, according to that list. Even if you arent tired one bit.
this is bypassing a logbook lookey-doo. They dont need to look at your logs to see if you are tired or whatever. Now this is being used as another way to shut down drivers and possibly impose fines. They can shut you down even if you have hours to run.
I cant find the interview online yet, but here is a teaser, sort of, from landlines blog:

This is becoming a horror story rather than just a bump in the road. I'm an ex bodybuilder come weightlifter with a 19" neck at 205 lbs. with around 17% bodyfat. I'm supposed to be 'tired' because my neck is a stump? I relax with tv to get to sleep, but that makes me tired? I didn't walk in and empty my little trash can, so missing that chore wears me out?
Get Real!bullhaulerswife and dieselbear Thank this.
