I have a very strong feeling that there is no real choice as to whether the survey is taken or not. If you are asked and you refuse, I predict that many will be placed out of service.

Put out for what? Not talking? No where is it located that this so called survey is part of the North American Inspection process. No where is this survey talked about in the CVSA OOS criteria. Personally I don't know why this has been going on for so long. I can only imagine the lawsuits that will come out of this.

I am not saying that they are not honest. But the survey allows for alot of interpretation. You refuse to participate, you look tired and bloodshot eyes. I think you are needing a break. It is between them and us.

If it were me, contact a good attorney and count the $$$$$$$$$$. I can't believe the MN patrol has condoned it's use. I imagine they have a legal cousel unit or an Attorney General that reviews stuff like this that could get them sued. I know with my Agency, we have a legal unit that looks at everything to curb the possiblity of lawsuits. Granted in the line of work I am in, lawsuits are part of the game. But why take unneccesary risks for stupid surveys and then place drivers OOS for it. Here I'm checking the log book two and three times to verify I have a OOS before I put it in writing, guess they could care less, your OOS for your TV, cell, and that pee bottle. -

I have heard that drivers refusing to take the survey are they getting a full inspection. Could it be that the refusal is giving MN troopers reasonable suspicion, the same way California does with traffic stops and refusal for a search gives them probable cause to search anyway?
