    These suits have already happened, there was one here in Colo. based on the original MMJ laws involving an employee of Dish Network in their call center, Dish prevailed in the case, companies are allowed to set their own requirements for a drug/alcohol free workplace, don't like it, go someplace else.

    Good to know that.

    Also, federal contractors are required to have a drug free workplace as part of their contract with the government....regardless of what any state law says.

    Even if all 50 states made marijuana legal, the Fmcsa will not change their current policy.

    Good to see this clarified. And no, I don't smoke dope, on or off duty. Just some simple libertarian leaning questions I had. Thanks for the answers.

    I can think of a lot of other career choices than trucking if you need to toke up. This is not the one.

    Smoke up on your home time in a legal state,... get into an accident 3 - 4 days later. Fault or not at fault.. the list of problems you could have avoided by just drinking a beer or two.

    Take Nancy's advice. Just say no.

    And there's 1 of the differences between pot & booze. Water soluble. Weather your 5ppm thc or .008 bac your still under the influence. One just takes longer to clean out. Are the effects in judgement ect. obvious? Not likely. But since ppl abuse everything it's zero tolerance. Heck they're stupid sober.

    Forget it. It's a federal ban on the stuff. Thus your involved in a federal line of work trucking and it will get you tossed so fast... Don't even think about it.

    Here is something else to consider. Arkansas allows Medical Use now having passed our elections this month but bans any recreational pot. It will be a few months before pain patients are given the option and information necessary to buy pot in dispensaries.

    If you are a medical pot user in our state in our laws with a doctor prescribing, you have also lost your right to 2nd amendment, not being allowed to possess, own or buy guns while on a prescription for the drug.

    It does not matter when it comes to making mistakes while driving doped, the police will still arrest you.

    I have to be hard on anyone who thinks they can smoke pot and somehow be a trucker. It's not happening. The police would absolutely for lackof a better term fall over themselves to bust a drugged up or drug possessing trucker. Then go after the company (God help them...) And since it's automatic federal, they can send you far away to sit and stew waiting for your trial.

    The big issue is the Federal Government considers Pot a schedule drug. As long that stuff is kept on one of 4 scheduled lists no one is going to be legal anywhere in the USA in a big truck or otherwise once the feds get involved. The States have no defense except to leave the Union itself and become soveriegn.

    Knee jerk about the weapons and pot. There are a few states like that. Arkansas pot really? ;-)
