I'd like to know who gave it the proper shipping name and then claimed iy was non r.c.r.a. Maybe if you explained what you did with the product we might have a better understanding of what was required. But if you get out onto the highways I'm affraid someday you'll get caught and will never drive again.

Due to the nature of fuel and water to seperate PHMSA has issued an interpretation that any amount of fuel and water is still fuel as the fuel will float to the surface and be a potential ignition source.

More often than not a facility will sell the diesel fuel as a fuel source to the producers of asphalt. The EPA has issued interpretations that a material is not a waste if it has any commercial value.
While diesel and water may not be suitable to burn in an engine, it si suitable to burned in kleins where the btu factor is more important than the purity.
If you have any amount of fuel in water you have a flammable liquid NOS. For diesel fuel and water you may use a non-DOT tank; however, for gasoline and water you'd have to use a DOT specification package.

Raytheon was prosecuted in 2005 for shipping water fuel mixtures without a proper shipping paper.

I'll answer his question. I hope your answer is 49CFR parts 100 to 177. Because if it's not you're more lost than you already are. And it shows you don't care since you do not even know what the proper shipping name is. There's no such thing as non-rcra hazardous liquaid. And to find the flammability you look at table §172.101 unless you're a certified lab.
But the one that gets me the best is the one that you think you can just pick up any old load because someone tells you to. How stupid are you really? what if the load was full of something they wanted off that they didn't want to pay for the hazmat team to come in and clean it up. If you do have all the books as you claim it would be nice if you read them and then you'd see 49CFR 100-177 §171.2. See how easy that is?
BTW, rcra means RESOURCE CONSERVATION AND RECOVERY ACY of 1976 It's the federal laws that regulates hazardous waste. And if your made up shipping name says non-rcra that means it's not a waste which it is by law. Here I'll quote you some of that that one too. Legally, a hazardous waste is any discarded material,liquid,or solid that contains sustances know to be (1) Fatal to humans or labortory animals in low doses,(2) toxic,carinogenic so on and so.
