DFW, TX: Hey guys. I need some serious advice. Basically, I’m struggling to get a job currently because of a “company violation” which was a failed hair follicle.
I stopped all smoking almost 1 year ago and my hair follicle was clean at my first job (the test results only went 90 days back) - I lost this job due to overstaffing.
At this second company, I did the urine and hair follicle test. The urine passed, but the hair follicle tested positive for THC and the company told me that this test goes back 2 years! Ive heard you have 72 hours to “dispute” the drug test, but it is past the 72 hours. The only other option I was given was to write a letter trying to dispute the “violation”
Anyway, this was a pre-employment test and I was only in orientation but the company put it on my DAC as a company violation and not a failed test. I’ve applied at 2 other megas, and they are saying that they can’t take me due to this. Was supposed to have orientation with USX and they said that I’m “unqualified” due to the “company violation”
As I stated, I stopped smoking almost a year ago. (Stopped January 2025) and the 90-Day follicle test at my first job was clean. But this 2-Year test was not. I’ve only had my CDL for about 4-5 months now and am not sure what to do from here. Any advice is appreciated!
*** nothing is in my clearinghouse. It’s clean. These mega companies are apparently seeing this on my DAC report.

I know this is after the fact, but anyone that wants to enter trucking and has used weed or whatever, get a buzz cut. It'll grow back.

The hair follicle fiasco isn’t DOT, so it shouldn’t affect the clearinghouse.

You are entitled to at least 1 free DAC report per year. Some states you are entitled to more than 1 free report. You should go to the Hire Right web site and get a free copy of your report. Hire Right, the people that run DAC, have very strict rules. But if you follow their rules you can challenge the negative entry on your report and hope the employer doesn't reaffirm the entry. You can submit a brief statement to Hire Right, following all of the rules stated on the Hire Right web site, that will be given to every company requesting a report on you. If you make your statement even 1 word too long, or some other violation of their rules, your statement will not be passed along.
The industry is very slow now and having negative info on your record isn't going to push your application to the front of anyone's hiring list. I've heard, but don't know if it's true, that dump truck operators are more likely to hire drivers with a DUI/drug entry than other types of trucking. I don't know if dump truck operators are as slow as OTR or not. How long is your hair? I assume long hair allows them to look farther back into your past, so to speak. I don't know much about it. I guess the good news is only half or less of trucking companies even use DAC. So not every employer will see that report. I suspect, like MOST young new drivers you have a hard time telling the difference between an employer with no web site and that employer not existing. That's to say, it easier to apply for companies online than to companies that don't do everything online. But, you need to look for smaller companies and that almost certainly means making phone calls <shudder> and even walking into offices <double shudder> to apply for a job. Whatever hair style you prefer, i would suggest having long hair AND an issue about a drug test are not going to help you get the next job. If you have long hair, and if it's JUST hair, then cutting it short is just a styling choice and not a big deal.Flat Earth Trucker and austinmike Thank this. -
If it's on your DAC as a company violation, then thats all you need to put on your applocation. Don't give any details or anything like that. If they want details, create a story. A hair follicle test is not a DOT recognized test.wis bang, austinmike, Albertaflatbed and 3 others Thank this.
