Imminent Hazard on MVR

    In late 2016 I tested positive for marijuana in a pre employment urine test. I know... stupid... It'll NEVER happen again. I don't even want to see a picture of the #### plant. In late April 2017 I received a notice from Federal Motor Carrier about completing a SAP program to make sure my license remained in good standing. I pay the SAP $300 and pay for a drug screen... passed. I attend 6 drug and alcohol group meetings when I come home from work. I submit the paper to the SAP and assume everything is completed. I return to work at the beginning of August to find out my license is suspended. I find out that my paper from SAP was never sent to Federal Motor Carrier. SAP says I need to take a drug screen. I pay for another one and pass. FMC says it needs to be a "Return to Duty" test. So I have to go back (pay again) for another drug screen - pass that one. Pay the DMV to have license reinstated.

    Now I have "imminent hazard" listed on my MVR. I have applied to several companies and once they see that, they don't go any further with the hiring process. I explain everything on applications and still nothing. Yes I messed up but ever since then I have passed two hair sample test and four urine test. I contacted my driver legal plan, they said because I completed the program it shouldn't be hard to have it removed myself. I have emailed the SAP (no reply yet) and the Federal Motor Carrier.

    Does anyone have any advice, knowledge, or tips for having this removed?

    Does anyone know how bad "imminent hazard" is. By definition... it sounds horrible. On my MVR no points are noted though. Anything is appreciated.

    I was unemployed at the time... with a crazy pregnant woman at home (joking)... I messed up. She knew the employer and called one day "go take a drug screen ACME is going to hire you!" I should've been honest... I really thought my system was clean. I have NEVER operated a commercial or private vehicle under the influence of ANYTHING. I have had my CDL for a year and a half... haven't even had a ticket. Drive safe.. no wrecks, etc.

    Well... A lot older (50+) people post on this forum for with a rather conservative view point. Any mention of weed means you're some burnout hippy who can't be responsible, ever. They don't care if it was 20 or 30 years ago, let alone less than two.

    Get a rain coat, the storm is coming.

    Maybe a lawyer and a couple thousand bucks might, and i mean "might" be able to get that expunged from your MVR. Only a conversation with a traffic type lawyer in your area will give you the correct answer. It's not the companies that are running the show, it's the insurance companies. If insurance won't cover you, no company will hire you.

    Expunged?

    No but a good lawyer would get it removed, but if someone does a good background check, it will all show up.

    The traffic lawyer that I spoke to said it shouldn't be on my MVR since I completed the program... They said I should be able to resolve it myself.... I've never heard of a lawyer turning down a simple case. Have you heard of imminent hazard? Why aren't points noted? Is that normal?

    9. What is an imminent hazard?

    The Federal definition of an imminent hazard is the existence of a condition that presents a substantial likelihood that death, serious illness, severe personal injury, or a substantial endangerment to health, property, or the environment may occur before the reasonably foreseeable completion date of a formal proceeding begun to lessen the risk of that death, illness, injury or endangerment.

    Just an example, but it sounds like a HUGE deal. It's almost as if ya cdl has been temporarily placed in a psych ward.

    Seriously!! Man I needed that laugh... That's the website I found the majority of my info... Cant find any details for Louisiana. Waiting to hear back from FMC.... supervisor is out until 09/05.
