Intrastate permits

    A question has come up regarding intrastate permits. I was under the impression that even if you have interstate authority - that if you ever haul intrastate loads in some states - that they require you have a permit to do so. Your interstate authority does not necessarily allow you to haul intrastate loads in some states? Is this correct? Or are intrastate permits only for carriers domiciled in a state but never leave it? Thought I knew the answer to this but now I'm confused. Are these intrastate permits, if they are required for an interstate carrier doing intrastate loads, required to be in the truck produced on demand? I guess this is a question that has 48 different answers.

    And it can be asked 48 different ways..My understanding is a state can ask any carrier for a permit..intra or inter does not matter..But the question is "why do you need a permit" if you have interstate authority for all states you can run in each state..but if your doing other things outside of your authority then you must be permmitted..ie oversize,weight,height things like that.

    Hauling an intrastate load also may create tax nexus, meaning you may have to file an income tax return for that state even if you otherwise are exempt from multi-state returns under the Amtrak Act

    Maybe this will clear up my question a little. My question would be - are you required to be permitted to haul an intrastate load in (say for example) Texas if you're an interstate carrier based in Tennessee. So I am based in Tennessee and have interstate authority. I'm in Dallas and book a load from Dallas to Fort Worth. Does this require a special permit or is my interstate authority going to cover that?

    Your good, you can haul loads from dallas to el paso and back all year long and never leave the state of the texas.on your interstate authority ..this I am 100% sure about.

    TX will hammer you for it if caught. There are a few that still require intrastate to operate. Most don't.

    Texas has no income tax, so no nexus, but they do require intrastate authority for runs like you describe (99% of people get away with not having the proper permit):

    Depending on the company stucture TX does have an tax.

    Sorry, yes, I'm assuming Sole Proprietorship. Corporations do not qualify as an "interstate transportation worker" so they are not covered under the Amtrak Act and are supposed to file returns anyway...
