Call OOIDA. If you are a member they will call and negotiate with the broker for you. I know this from experience. I called just to find out what I could legally do. OOIDA asked if I wanted them to call and negotiate for me. I declined onece they informed me of my options. I made that call within an hour of a load being turned around. Was turned around because receiver wasn't ready for the load for another month. Didn't have a crane to unload. Broker wanted us to haul load from Al back to Ft Worth for same price that we hauled it for. Even though it was a decent rate it wasn't close to what we get for going that direction. After bypassing broker and letting shipper know that it was about to get real expensive for them they agreed to our rate. Didn't gouge them but got what we normally get for going that direction. Shipper had no problem and we still haul for them. Broker was pissed but they still have to give us freight from that shipper. The shipper ships everything through this broker.
Long story short, OOIDA Can advise you and know the laws.
