Clearly that’s not how op took that photo. It’s taken from two different angles including from the driver side window. Therefore he was definitely holding the phone while taking the pic.
It’s strange that he’d call the other driver out on holding a cell phone without actually knowing if he did, while at the same time doing the same thing he accused the other driver of doing. Plain stupid.

 

Op is the type of driver who whips out his camera when driving by a crash scene, rather than be extra vigilant and cautious he’s more worried about getting a photo.
