Lumper Fees...

    I know that by law lumper fees are required to be reimbursed. My question is who is responsible for the reimbursement. As a shipper hiring carriers, I am reimbursing at this time. I feel the company charging or requiring the use of lumpers should also be required to pay those fees back to the drivers. The language of the law is vague. It just says that somebody has to pay. Has anyone ever invoiced a receiver for lumper reimbursements?

    No expert. I only dealt with lumpers a handful of times and these were always brokered loads.Doesnt make sense,acompany ordering a load of product then charging you to deliver it to them? The broker (salesman at our company) was responsible for figuring in any lumper fees into the price he quoted to make the delivery. If he didnt he basically made less commision or just ate it.We company drivers never paid out of pocket.Our company paid it by Comcheck etc.Then recouped it out of their company salesman's cut of the delivery fee. So,if he agreed to make the delivery for $200 say and didnt figure in the $100 lumper fee. Our delivery company just kept all of our salesmans commision and chewed on him to at least recoup all there expense.Sysco seemed to be making bank on lumper fee. 5 trailers constantly being unloaded at $100 a pop.

    If the receiver your delivering to is charging $100 for there deliveries you should pad $100 on top of their total bill.

    There is so much nonsence in the whole unloading fee thing--it is almost impossible to fight thru--as for how/who pays....
    All of our better shippers handle it this way.....we lay it out...add it to freight bill and shipper reimburses us....
    Of course they(shipper/manufact)raises price of product to their customer--typically by enough to recover lumper fees--and any other associated with it...plus a little xtra for the aggrivation...

    Think about what Walmart brings in every day, at $50/truck.

    That's nothing Coremark is $450 for my full truck load...

    Never heard of Coremark. How many deliveries do they get a day.

    100's. They are one of the largest grocery distributors in the country. They are making money hand over fist with their lumpers.

    Excerpt from the Super-Valu case.

    Based upon the rules of statutory construction and the legislative history of the statute, the Court concluded that “Congress did not intend § 14103(a) to impose on any particular party an unqualified duty to reimburse incurred lumping fees.”

    It,s not required you are free to break down all 1000 cases into 60 skids after pulling them off with a fifty year old rickity manual jack at an incline but we need the door it needs to be done in two hours or we will fine you
