Need a second chance, please help

    I hope you don't mean me. Like I said, I'm in the same boat regarding my wife, I just haven't physically lost her yet. I know before it's over, it's only going to get worse.
    Truckin101, I keep telling myself it will get better, and through experience, I've found it does. You just can't give up, and burning one every so often is just that. It's no different than drinking yourself into a stupor. The reality still remains. I'm not trying to be hard on you, Lord knows you don't need that, maybe just jarred a little? Right now, myself, I'm looking at nursing homes, I just can't do it any longer, but I'm still trying to maintain and do what I have to. You too can. I've read this post a couple times now, and it seems like a weak attempt to try and help you, but it's meant in all sincerity.

    No, john, not you. I just can't believe how callous some folks can be, maybe because they're on an internet forum. I'm a gun advocate, anti-drug (retired cop), but I certainly smoked some in high school, poltical conservative, anti-lazy people, etc..... but a few guys here jump into threads just to spout off about their own personal agenda - it gets old.

    This guy's wife died, and that didn't slow a couple guys down one bit.

    I've always been of the notion that if you can't actually help in a topic, stay out...or go argue with a fence post.

    I can't begin to comprehend the loss of this guy's wife. But what I do know is that what is illegal is illegal. And actions have consequences, and now on top of your suffering from a terrible loss, you are suffering for disobeying the law. And whether the law is good, bad, right, or wrong, or how many folks do or did it doesn't matter.

    No one knows how they would react in such a situation. My wife and I have been married for 31 years. She has been chronically ill for several years and seems to be getting worse. She needs someone to be around most of the time. When you have someone close who is chronically ill you do think about what could happen and how you might react. I don't see any reason why anyone should judge someone for what they did during a time of crisis. He messed up and is now suffering the consequences. He cannot change the past, but can learn from his mistakes and go forward.

    We all make mistakes. Who knows, this guy may make someone a good driver if he can convince a company to give him a chance.

    If you haven't smoked in 3 months you should not fail the test, unless it was a hair test perhaps.

    All but maybe the smallest companies will have a question on their applications asking if you have ever failed or refused to take a drug test.

    IMHO you really need to discuss this with an attorney, both to get your DAC straightened out and see what to do about the drug test.

    I don't think you are forever screwed from driving again, you just need some professional assistance.

    An accurate DAC entry is going to be pretty much impossible to fight... might need to do something else, like warehouse work, for a while.

    There are only a couple of ways in which you can have information removed from your DAC. Either the information is incorrect or the company is willing to take the negative information off your record. A failed drug test is serious and most carriers are not going to be willing to take that off the DAC. You could put a letter in your file, but until some time passes, finding a driving job with a carrier who checks DAC will be difficult to over come. I have heard of some who have gone through some sort of drug program that has helped. I think it is called SAS?

    I agree with ronin. You may need to check with other types of non driving employment for a while.

    Some states require employers to notify the state of failed drug test. Then they disqualify you from driving a CMV till you complete a substance abuse program.

    Don't give up.

    I'm sorry you have to deal with this after your great loss.

    The process for having your DAC corrected is, I believe, essentially the same as having bad information removed from your credit report, something I have substantial experience with. There is a specific procedure to follow, and the request/notification must be in the correct format and contain the required information. After the request is delivered the credit reporting agency (or whoever does the DAC compilations) has a specified amount of time to correct the report. If the information on your report is not corrected within that time, then the agency (not the creditor or employer who placed the information there) is legally liable and subject to a lawsuit.

    This assumes that the information in dispute really is incorrect, which in the case of the OP would mean that he was not fired.

    From my experiences with the amount of bad inf on peoples credit reports, I have no doubt that DAC reports are just as screwed up, just another reason why I would never work for a company that uses them.
