Owner op cannot get unloaded, need advice, please

    I am dispatcher and my husband is owner op, so we have our own small trucking company. So we got a load, appt for pickup was 6.30 am , truck loaded 4.30pm. We informed broker and they were supposed to reschedule. No my driver is at the receiver and they are telling me next available appt is on the 26th. Which is in a week. Broker is telling that they cannot reach out to customer and trying to find solution. I called receiver myself and they confirmed that my guys will not get unloaded today plus they will be closed tomorrow and Saturday. So to sum up, it was not our fault missing appt. Now we decided to take this load back to shipper and file a claim, or find attorney to deal with that. Honestly never had such issue before. So I was wondering if someone had the same unpleasant experience ( I hope not though) and could give some piece of advice? What to do?

    Welcome to trucking. l assume your truck was at a grocery warehouse. Typical, get used to it.

    If this is a grocery load, it will happen. And you can potentially lose up to a week on these darned loads around this time of year. (Holidays etc)

    If you decided to dump the load back at the shipper, go find a new load that continues to make you revenue instead of babysitting a week.

    Well, thanks but we are not new to trucking, I just never had an issue like that before, and even if I did brokers were dealing with problem too.

    Taking the shipment back might have been the best move. How far did you travel?

    Keep copies of BOL. Do you have some proof that you was at the receiver? Dash cam, phone calls, pictures.
    Not sure how much money your looking for but you'll want to send a bill the broker, shipper and or receiver, take your pick.
    After 60 days give notice to file in court for failure to pay. 15 days later no payment file small claims in civil court.

    Yes, we decided to take it back to shipper, we will lose less on that, rather than just being cold storage for them :). Just wanted to see if someone else had experience like that and what did they do.

    Actually, I saw your response in another thread and it helped me in my decision. Thanks for that. :) Yes I have phone calls recorded, dash cam,names, also we have tracking and also broker's app shows that we arrived at the receiver. so they have tracking as well. your advice is good we will definitely take it to the next level. Thanks for advice.

    Be very careful recording phone conversations without consent. You can find yourself in legal hot water if every person involved in every conversation in every state isn't in a 1 party consent state. That's why when you call big companies in other states they say "This phone call may be monitored or recorded." By you continuing the conversation you are consenting to being recorded.

    Did you call the shipper and asked if they would accept the load back from you? I dread a situation like that myself, so I feel for you.
