    You should file a wage clam for all the hours he said you were driving. That would put him between a rock and a hard place.

    Can’t file a wage claim because he was working illegally as a 1099 contractor. But he could file a suit against him for the money if he knew exactly how much the guy said he drove.

    I don't know if I would try going after the money, or even report him anonymously.
    When (not if) he gets in a fatality wreck everyone will be named in the lawsuit. Even the ghost driver. I would be filing any complaint formally with any relevant agency. Be it IRS, FMCSA, etc. and I will do it with my name on everything.

    That way when the inevitable lawsuit comes there is a paper trail that I'm not working there, and even an effort to get them to stop.

    He isnt scrupulous about anything else, maybe protect yourself beginning there

    Yeh it was 1099 but he was running me like a w2. Kept bringing it up and he made up some ######## about his truck.(said I drove 60 miles with zero oil lol) ####er threw away all my road receipts, hotels and what not. One of his trucks is deleted and he sold another one that was deleted. Don’t think deleted emissions are a big deal actually, heard it’s not even an out of service citation. Cops asked me about him and his crew right before I left too. Last load he used me to pick up and gave it to another driver the broker refused to book it under.

    1st call THAT state dot and tell them everything
    2nd call fmcsa and tell them everything
    3rd call THAT state irs and tell them everything
    4th call the federal irs and tell them everything
    5th call that state workman's comp and tell them he's miss classifying w2 employees as 1099
    6th call that state unemployment and and tell them the same thing.....

    He's about to have multiple state and federal agencies crawl up his ### with a microscope....

    If you don't..(?)....well imagine a Florida Gator...bitting you on you rear end, ....well.........Fed's are a Lot worst.!!

    Get a lawyer, have them craft a cease and desist letter on your behalf, also document how you found out, contact the irs, your states attorneys office and the fmcsa to ask all of them how to file a complaint.

    here is why …

    If he is using you on any logs, gets into an accident and the logs are examined, your name shows up, YOU are now included in any liability involved because you were working for him which can cost you money for a defense lawyer. This then extends to if you are working for someone else under DOT regulations, they will be involved with a state investigation to find out how you are working two jobs.

    the second issue is the irs, he can claim he has been paying you for work you did and the logs are proof of that, leaving you on the hook for the taxes, the irs won’t give a crap what you say … he has proof that you were working for him.

    so get a lawyer and get moving on stopping him legally.
