Sorry it took so long to reply. I delivered the load. Topped the fuel off, and headed for the terminal. I arranged for a family member to meet me there so that I could get all of my belongings. I called left a message. Sent a text to PIC. then I headed home. Once I got home I received a text that said thank you that truck is being repossessed this weekend. But I have a truck for you to pick up in Indiana. SMH

Probably a 1099 job, which stops the Labor Board from helping. Only recourse is small claims court.
ZVar Thanks this. -
That stated that the person who was responsible for paying me is sinking in debt. And will not be able to make payroll for the drivers on his team. And that he is no longer with the company because of this since he is bringing the company down. That if I went to Indiana and picked up the truck there, I would be apart of his team and any back pay would not be replaced. Just future pay.

They stated that because I drive out of state, that there is nothing that they can do. If I only drove in Illinois they would be able to help. I am or I was a regional driver.Metallica88 Thanks this.

Colorado pulled the same line on me when I tried to go after a company based there that didn't pay me. I thanked them for the tutorial on how to commit wage theft in their state.SidewaysBentHalo, frizzbees, bzinger and 4 others Thank this.

Contact the Federal Department of Labor Hours and Wages and see what you can do. ALSO if they file bankruptcy, be one of their debt holders, it is public information.
One thing I hate to see is these cheap POS companies walking away from what they owe the drivers, I bet the office people got paid and so did everyone but the drivers.dunchues, brian991219, bzinger and 3 others Thank this. -
That will get you charged with theft of property.

thing here is IF the fuel card is shut off..what do you do.>??
do you put in enough to get home, provided you have the cash, or a credit card, and then stick your finger up your butt and hope they reimburse you..??
for me, i ALWAYS had a valid credit card.
in fact, there was at least 3 occassions i had to use that credit card, and i either went home by train (not a great experience doing that) or i'd fly home (best experience in doing that)..
there is no way to know for sure that by fueling up the truck to get home, one will be reimbursed and ya know what..??
what is lesser....air/train fare or fuel..??
now yes i know, it will be considered as equipment abandonment,
but.......if the company shuts down (and we know many have done so), one has to think of oneself first and foremost.
at least i always did..... -
Get a copy of the bounced check. Take it to your local court ask about filing a small claims case. You will win if it goes to trial but most likely they will pay you off before to drop the case, res judicata.
If it goes to trial ask for a judgement to take positioned assets. Bank accounts, trucks, trailers, equipment.
Let me know how it goes.lilnae Thanks this.
