Per diem pay

    I have a quick question regarding per diem pay. I was looking over my husband's paychecks and noticed a weekly $250 per diem. Every week it's the same. His mileage pay is .40 and than a $250 par diem in two separate columns. My husband was fired from his job and on his last pay check there was no per diem. Was the employer suppose to pay him the par diem?

    Short answer is NO. Per-Diem is voluntary from the employer, it is part of a benefit not a mandatory thing.

    Per diem is a tax exempt sum of the gross pay that is calculated per day as a way of easing the burden of food bills and the like incurred away from home.

    Short answer no.
    Unless it is expressly written into his employment contract and signed by his former employer.
    Usually it is the boss being a good and kind person, not something that they owe an employee.
    Especially an employee who screwed up so badly that they had to be fired.

    The per diem is deducted from the gross pay before taxes are taken out, then added back is as non-taxable income. That is why there are 2 entries for it.

    The going rate for per diem is $66 per each day away from home. Any driver not receiving $66 per day of tax free income, for each day away from home needs to leave the company asap...as they are being ripped off. Companies do have to pay it, as it results from the "driver", not the "company" being away from home. Perhaps we need some more class action lawsuits against trucking companies to clarify this. Most trucking companies don't deserve the drivers they have. You sound like office staff as another driver who knows what life is like on the road would never say, "especially an employee who screwed up so bad they had to be fired".

    Show me in the law where this exists please.
    Just a picture of the page in a law book is good enough for me.
    Or the link to the government website page.
    Maybe call and ask your accountant to help you find it.

    It's not a law ... It's an defined expense in the tax code ... If the employer pays it they can write it off. But there is nothing requiring them to pay it.

    It's like any other benefit - vacation, health care - the quality of any given benefit varies from employer to employer ... Choose your employer wisely.

    Here you stated that it was a must that the companies pay 66 dollars per day for each driver, and people need to revolt and file lawsuits...lol
    But it isn't a law.
    So good luck with your lawsuits.
    Maybe use common sense before posting #### that stirs people up.
    If a company is kind enough to pay it be very thankful.
    But they don't owe it to anyone by law.
    And after the person who this thread was written about crashed the company truck, it is ridiculous to expect that company to also do him another big favor.
    Holy #### this has turned into a stupid discussion.
    Go call a lawyer...ask them how to go about suing someone who hasn't broken any laws.
    Then report back here with their answer lol.

    What next sue Walmart because you had to see too many fat chicks?
    If you don't want to see fat chicks, don't shop there.
