Personal Conveyance

    So offduty driving will be largely used and abused once eld's become mandatory. According to the fmcsa rule there are no other restrictions beside being unladen and not repositioning for a next load.
    But who is to say if I am or not repositioning for a next load. Is there a time restriction on picking up a load after using PC??
    What if I deadhead on PC from Phoenix to San Diego then pick up a load in San Diego the next day which wasn't prebooked. Or I take the 34hr restart at home then find a load.
    How am I to prove that I moved without intention of repositioning the truck for the next load?

    From what i understand is you have to sgo back where you started pc.

    Nowhere in the regs does it state that you have to go back to where you started.

    I not sure but I believe it states you can't use pc to progress to your next load.
    But if you didn't have a load booked yet you could probally get away with it.

    our safety dept makes up their own restrictions for our personal conveyance. no trailers period,
    and a limited number of miles per day, call it company policy, we are contracted owner/operators

    Maybe not but that's the best way to show you're using the option judiciously and honestly and not trying to "cheat". When you think about it, if you DON'T do it that way, how can you NOT be trying to omit "working drive time"?

    Get dispatched by phone instead of Satellite communications.

    Move truck via PC.

    Dispatch, load, boogy, drop.

    Repeat.

    Coyld potentially save half your 70 this waynn and if you clean your phone's history its more difficult to prove.

    Plus, don't have to pay drivers for PC mileage. Heck, charge'em! Now drivers really do get to pay for the priviledge of droving truck, and the companies don't even have to screw around with the pretend lease option!

    The guidance from the feds says that if you are unladen you can use pc for personal use. If you use it to go home or to the mall or whatever, you can log off duty. But if you are then dispatched from wherever you went, you are on duty when you leave.
    It would not surprise me to see this used so much with elogs to have the dot consider pc to be a major problem. Maybe see the feds change the pc thing altogether.

    That's what I understand as well. It's like Nascar, you can't advance yoiur position.

    What till the country comes to a complete stand still then they'll realize how ridiculous ELD's are.
