I work for a private carrier that manufactures roof trusses. Most of my loads are oversize. From time to time ive been asked to take loads that are beyond the scope of the permit. The company is also bad about not keeping the trucks in safe condition. If I refuse to take a load on a truck that has safety violations can i be fired?

refusing a load for safety is what your suppose to do... never never take any load that will jepordize you and the public because your company wants you to... If you refuse a load for this reason and you get fired... take pictures and see an attorney or better still call the Local DOT Office and have them come do an inspection...Then call a lawyer if they fire you...you are the commander of your ship on the road..you are responsible for the safety and write ups...

You are in one of those 'no win' situations. Hell at least your company get some sort of permit. Around here the truss outfits just 'run it'. Just like the readymix trucks around here. Every load is overweight. They get stopped but it is financially positive for them. If you refuse you will get fired or they will force you out. Just find another job asap. IMHO.

I would either talk with the bossman and tell him his company needs to comply or, come back in one day and say, "Dot stopped me and gave me a verbal on overweight or oversize or whatever". Then see if bossman wants to act on it. But I'd say probably not. Sounds like that's their style.

Unfortunately, right now I'm taking any load that I can get. If I get pulled over I'll get a ticket, there is really nothing I can do about it.

Of course they can fire you. They can fire you for chewing gum to loudly, or because they dont like the size of your shoes.

How much over are we talking? I've seen some drivers throw a fit for some stuff even the cops would laugh at.

I had this happen once. I called DOT 1 mile from the shop and told them I was over and also truck was unsafe. they came out inspected and cited me and then went to the shop and started nailing every truck in the place. I walked in and quit on the spot. the judge threw the ticket out as the officer explained that I called them and that he witnessed me quitting. its not on my dac so I guess I'm good.

I know it's tough but you can always do something about it. Look over some of these postings and apply it to your situation. If you go ahead and take the chances that's your business but just remember that no matter what you do if you're involved in a bad accident the opposing attorney will place the blame on you and there's not much you can do then. I've seen it happen and the driver was no way at fault. Best of luck to you.
