In Northern California about 2 hours out of sacramento

57 years old, I think a lot of it was my company trying to get rid of older

I should have done that last year. But I retired this was last year. I now realize they were trying to get rid of me .

Age discrimination is the one companies can still get away with. It's very hard to prove.
Grubby and Toomanybikes Thank this. -
Just look at the ones running the show anymore, they are the children of ours and some of them never really worked a real day of work, in our younger days we were forced to work long hours and sometimes with no protections for us. Now we are wore out and most just stick the aged into retirement homes. That is a way to get everything you worked for all your life, there is a long line grabbing as you go, better go do all them things you wanted because time is short.
Grubby Thanks this. -
57 is not old, that is just very much experienced, and some of that is needed.
Grubby Thanks this. -
No it's not. Not in this situation. The OP needs to get his personnel file.
Garcia: Did you have decent performance reviews up until age 55? This is how you prove it. You had great performance reviews and no issues. Once age 55 comes around, you get a manager riding your ### and "papering" your file. You start getting written up for petty things--the big picture shows that this is all to encourage you to quit. This is a wrongful termination under the law, called a constructive dismissal. Constructive dismissal is harder to prove than age discrimination.
I think you need to call a lawyer. Doesn't matter if this was last year. The statute of limitations is still good, I think. You're in California and you need to talk to an employment attorney. California law has your back.
You gotta be aggressive man. This is a knife to the neck moment. I think you have 3 years from the date the violation occurred to file on them. You should put a complaint in with DFEH first, to make sure the clock doesn't run out. Then call some attorneys, and I know of a few good ones who practice in the Bay Area and Sacramento.
God I'm such a poser. I'm not a lawyer and this isn't legal advice. -
Actually I was making a general statement not to this situation. One good thing about the trucking industry is you can get hired at an advanced age. Try that in the rest of the workforce other than Walmart door greeter. If you don't think age discrimination in hiring is going on all across this country you're fooling yourself.
Grubby and BUMBACLADWAR Thank this.
