Sem Managment/RoseRock Midstream

My husband has been trucking for many many years now and never before have we run into such a horrible company. First off he originally worked for Barcas Field service LLC, that company was bought by Sem Group Corp also called rose rock midstream for $45 million. My husband was offer to keep his job under the new owners. They told all of there drivers that the pay scale would change but they would be making more than with barcas. This was in September of 2013. From that day it started out ok but steadily his pay was going down. he was getting paid less per barrel suddenly and not paid for half his miles. Also his truck kept breaking down and so he spent a lot of time in the shop with it. It is their truck not his and they could not seem to keep him in a good working truck. He would spend 8 to 9 hours waiting for his truck to be repaired and was only compensated for 1 hour of that time. Another example of his break down issues, they finally said well bring it down to the shop in texas and we will send you back up with a different truck. So he drove the 300 or so miles to take that truck down and get a different one. He got the other truck and started back with it and in about 100 miles out it also broke down and had to be brought back to the shop. So he took it back and they fixed it and sent him back on his way. Now his whole day has been wasted doing what they told him to do and the only thing he got paid for was the 100 mile from the second breakdown back to the shop in texas. We was not paid for any of the other miles driven that day he didn't even get the 1 hour they usually toss him when he is in the shop.
On the second note with this company he would send in his load tickets to be paid for them, and half the time he was shorted by a few loads. Even though he sent all his load tickets in 1 envelope they said the received the ones he was shorted late. I tried to find out how some were late but some were not if they were sent in in the same envelope. They could not tell me. We have been told by someone in payroll that the person who does the ticket input runs out of time in her day and just time stamps some as having come in late so she can leave at the proper time. That is just hearsay but that is what we were told at one point. And when they short his checks like that they make him wait the 2 weeks until his next pay period to get those loads added to his set for that week. Because of this we kept having to over draft our bank a few times because they shorted him so much and some things cannot wait another 2 weeks.

So my husband has now stopped working for them on June 12th. This is also an issue, they have a safety bonus program and on june 1st safety bonuses are supposed to be processed. The way the bonus works is from December 1st until may 31st if there are no incidents and such you get a safety bonus and also from june 1st to November 31st. He got his bonus in December. But they started processing the june bonus on the 1st and then distributed them on the 20th. And even though he had worked for them without inceident and was still working for them for almost the first 2 weeks of this month they said he had to still be employed when the checks are processed and cut. he was still employed during processing and he did earn it. I though it funny that while talking to the lady in payroll about it she said it is in their company policy about it, but in the next sentence she said even the people in corporate have missed out and complained saying they were employed for that time. So no the employees do not know this policy.

I wish there was a way to get some of the money that they owe my husband. They even shorted his last paycheck on the 18th by like 4 loads totally about $500. So for a 2 week paycheck he brought home $600 and of course they are making him wait for the rest. Now we have a family of 7 and we cannot live on that kind of crap. I would love to see that we could sue them for all the stuff they have done. There is quite a bit more but I have already written a book here really. Any advice would be great thank you.
