    if you run a team, but your semi does not have a sleeper can the person not driving the truck regester rest time by sitting in the passanger seat?

    To add to the above, no! If the truck doesn't have a sleeper, only a motel receipt is going to prove a rest period. Time spent in a seat does not qualify, and hasn't as long as there have been rules and trucks.

    In fact, even if the truck has a sleeper, it still may not work. One of our competitors bought a bunch of small Freightliners with the "Day sleeper" option, which is a small 26" sleeper shelf behind the driver. Their idea was to use the truck as day cabs, but if the driver got delayed, he could claim sleeper time to stop the clock under the old HOS rules. But the DOT ruled that the small sleepers did not meet the legal size requirements for a sleeper berth and disallowed the sleeper times during an inspection. Part of the DOT regulations are increased sizes of sleepers over the years. Those trucks would only be legal if they were pre 1958 models!

    Team non sleeper on duty.

    No sleeper no rest.

    You have 14 hours to get the work done. Get going, yer both late. =)
