On Saturday, November 12[SUP]th[/SUP] at approximately 1:00 AM, I was driving southbound on Interstate 5 between Sacramento and Stockton. The weather was clear, and there was no moonlight. The road was dry, and there was little traffic. I was traveling at a rate of approximately 55 mph. Aproximately ¼ mi before the collision, I rounded a slight curve in the highway. There were no cars visible on the road in front of me, and only 1 SUV approaching in the left lane behind me. As I rounded the curve, I was scanning the road in front of me, and noticed an object ahead beside the travel portion of the roadway, but could not detect what it was. Through consistent scanning of my mirrors, I detected the SUV beginning to pass in the left lane. I maintained speed, because I had no reason to suspect that the vehicle passing me would attempt to occupy the space in the right lane that I was occupying, as we approached the object on the shoulder of the roadway, I noticed the SUV suddenly swerve toward, and into the right lane (my lane of travel) In order to avoid a collision with the SUV, I instinctively pulled to the right to allow room, As I did that I collided with the car that had been abandoned on the side of the road. At that point in time, I attempted to stop, as the truck careened off of the interstate, and into a vineyard. As soon as the truck stopped, I exited the vehicle, and ran back to the highway to assess whether or not anybody had been injured in the car that had been struck. Luckily, nobody was in that car, and I was not injured, but now I have to worry about whether or not I'll still have a job. Was this accident preventable or non-preventable?

Hard to say. Did the SUV stop and offer any explanation? Did you or the SUV actually cross the center stripe while alongside the other? Had the road straightened out once you reached the location where the vehicle was on the shoulder or was it in the middle of a long, shallow curve area of the Interstate?

You should have let the guy hit you. Instead you hit a vehicle parked on the Shoulder. Preventable YES.

You will be hit with a preventable. The only facts that can be confirmed is that you hit a stationary vehicle on the shoulder of the road. You never slowed down, although you clearly saw an "object" up ahead. Had you slowed down you may have been able to prevent this accident...either by having the SUV clear you and allowing you to get in the left lane, or even if he did cut you off, allowing you to stop safely.
Also you made an incorrect assumption...it was Saturday at 1am...somwhere in the back of your mind you have to consider this is prime hours for driving under the influenceTRKRSHONEY Thanks this. -
I guess only you know the answer. Ask yourself .. knowing what you now know and having experienced the results of such a situation, if you ever find yourself in an identical situation, will you do/not do the same things and allow the situation to progress the same? If you answer "I'll do something different", then perhaps it is a preventable on you.

The truth is you acted instinctively to prevent an accident that could have ended with injuries or a possible death (depending on what may have happened if the SUV had struck the vehicle, and how the driver reacted).
The other truth is that you have no proof that the SUV even existed, and you struck a parked vehicle. So yes, you will get hit with a preventable accident through no fault of your own. You are a truck driver, you were within 25 miles of an accident, YOU are at fault. It sucks, but that is the world we live in. A world where no one takes responsibility for their own actions and happily screws over the other guy.TRKRSHONEY Thanks this. -
Well its about like the dodging the deer you have no proof that the SUV was there so you company going to look at it as it wasnt and depend on the company you may need to start job hunting but yes there was many ways to prevent it who's to say that had you stayed in your lane the SUV would have hit you. You ran off the road and hit a parked vehicle. What it there was a family in that parked vehicle and a drunk in the SUV kill the family to save the drunk and as you stated you saw something on the shoulder from a distance this should have told you to take cauction not just maintain and hope nothing happen

I have to disagree with that comment. Who was at the wheel? That parked car on the shoulder wouldn't have been hit had he not left his lane. Leaving his lane is what made the crash his fault....and therefore preventable.

You saw a mysterious object ahead.
