I've read through the FMSCR and NSC-10 load securement regulations so many times for training purposes, my head would spin. Nowhere in there does it ever say that van pullers are exempt from cargo securement regulations (in fact, there is an entire section for securement inside of a box trailer).
The only people who are exempt from cargo securement regulations are those pulling a trailer containing a "bulk" product, either dry or liquid or gas that is contained in the structure of the trailer (i.e. a tanker or pneumatic) because by the nature of the trailer and the product, there is no way to "secure" it beyond closing a tank lid or valve. Which also means they are exempt from load checks, ensuring their load hasn't shifted during transport (which I found very surprising, but understand why).
It sounds like your friend got nailed for being lazy and not properly securing and by extension, checking on, his load before crossing the scale.
As a deck puller, I'm super-anal about my load checks. I'm checking my securement each and every time I stop throughout the day, even if it hasn't moved since the first time I checked it. I'm not going to be responsible for killing someone with a load of steel, and I'm sure as hell not going to get a ticket for an insecure load when I'm looking to make a down-payment for a house.Gibraltar, Oxbow, x1Heavy and 1 other person Thank this. -
Interesting. We've been inspected couple times at that scale. We haul 24 totes in a van. But we load them stacked against the out side wall. The totes are 43 inches wide in a 102 reefer van. Enough room between the totes for skinny guy to squeeze through. So far, no problems, but It may be they have just learned a new trick.
I do know my driver times his run go through their when they are closed. -

Take a load of Seagrams, feel the slosh and get back to me.
It was taught to me by my trainer then in my third month my first year as a training tool prior to hauling the then new container tankers that have tons of fluid inside of them.
You can scream BS all you want under all Heaven, it's fine by me. I drove that thing and felt the slosh.
