MVR/DAC question. (Landstar)

    Another thing to keep in mind is if you were somehow able to pay a fine and have the ticket removed from your record your company most likely will still have you down as still having a ticket. I've been through this with a previous employer with similar circumstances (speed limit drop from 55 to 30 with no warning, ticket written for 13mph over, dismissed in court and not on my record) and one of the company's "safety" reps told me "just because the ticket was dismissed doesn't mean you're not guilty. You were speeding". Biggest crock of #### I'd heard yet (I've heard worse since but I won't go there).

    i wouldn't call the courts on monday. there's nothing they can do till they get the ticket in their system. and that takes 30 days. or up to.

    that's been my experience anyways.

    i got a ticket in wyoming when i first came back out. 45 days before i could pay. but it was 60 fdays before they could find the ticket so i could pay it.

    First thing I would have done is gone back and measured the distance between those signs. I would have paced off the distance between the signs while recording it to video on my phone (yes I have actually done this). Since you obviously didn't do this (who would except for me LOL), is there any chance you still have the video on a dash cam?

    Then I would check the rules in Montana pertaining to distance required between signs. I am pretty sure the cops don't place those signs...the construction company does so it may not have been enough time for you to slow. Also check to make sure the sign was at the proper height and distance from the edge of the road. Also make sure the sign was the proper size.

    Reason I say that is because I had a cop follow me through a (non-active) construction zone one time in NY state. There was no sign to reduce speed so I did 50 all the way through. He pulled me over after and was going to write me a speeding ticket. I said "I knew you were back there and there is no speed reduction". He disagreed. I said "Let's jump in your cruiser right now and take a look." He let me go. He let me go because he didn't know if there was a sign there or not.

    Do everything you can to find a loop hole.

    No. And even if there was, it was a 30 mile decrease !! I've never seen 35 mph on an interstate. Going down a grade at that. Come on,

    Yeah, Landstar knows, I faxed it to them already...

    And nd no dash cam, it was just on my list to get. Didn't go back and count the distance on film which would of been a good idea.

    and here's the kicker, there's only 10 days (05-19-14) until I must appear in court or pay cash bond.

    Look man, you can't tell me what I have and haven't seen. Even if I have, it is implied that 35mph on the interstate is a rarity. When there's a sign that says construction ahead you slow down expecting a 55/45mph speed zone. 35 is a new one for me.

    Why would you tell any company about the ticket! You don't have to legally tell them until it's a conviction. A ticket is not a conviction! This isn't truckstop lawyer talk, this is something every driver should know. Now, if you get that ticket reduced to a 5 over, Landstar still knows you were doing 18 over. if you get that ticket thrown out, Landstar still knows you got a ticket!
