Dispatcher company stole my driver

I always thought if a driver was to told what time to pick up and deliver and not his equipment, no 1099 should be issued by owner. I not 100 percent sure on this.

I am currently not satisfied with my dispatch service who I am leased on with, and looking for any others who have a good reputation.
I will explain my situation breifly:
I am an owner, and I have a driver, I have leased my truck to a company, where they provide me loads. I can accept or reject as I please. They put me on their Insurance and provide a fuel card. I am also paid weekly. The cost of this is at 12% of my Gross.
Looking for somewhere cheaper that can provide the same service.

I assume you're not subscribed to DAC......if you were you could mess his DAC up pretty bad and he wouldn't have a choice but to come back to work for you.

88% is above average and I don't know any reputable places that will give you that much or more. The reputable places usually pay 75%. It's pretty easy to find 80-88% and I think I saw an add for 90% by a company I have never heard of or seen. But good luck in your search.

Look there are a lot of companies out there, you have to find a few who will be willing to charge you 12%.
As for the 1099 of the driver, that's alright too. As long as you and he/she understands the relationship and how it all supposed to work, then it is good but the non-compete clause thing is a problem for you because he is contracted as a driver nothing more and has the freedom to leave or stay at his will, it is part of a problem with many who think that indentured servitude is still alive - not saying you but there are owners who are just downright mean. The best thing you can do is ... nothing because say you find someone and he/she does drive for you for a while and then gets an offer to work for one of your customers, your contractual limit can't be enforced without other problems for you, like he can claim he is an employee because you choose the loads and not him - this is one example of possibly many.The blue guy and Lite bug Thank this. -
