BAC and driving

    Well regardless.....Neither you or I can stop people from doing what THEY want to do. He never once hinted about sneaking around anything just a simple question so that he would not get in trouble by making the wrong decision.

    First of all, thanks for your service.

    Secondly, I had forgotten who said that until now so the only one making this personal is you.

    Thirdly, I'm sure you are very knowledgeable of the UCMJ and the laws as they apply to the jurisdictions that your LEO friends are under.

    However, I know for a fact that there is NO federal law that states the legal BAC limit for a CDL holder driving ANY vehicle is .04.

    If that were the case, I woulda been arrested many times.

    It's up to the state to determine the laws within the confines of federal regulations as a minimum, which does not trump anything technically speaking.

    However, this is semantics and doesn't amount to a hill of beans in the grand scheme of things.

    The point is that a jury doesnt care if your underbthe blegal DOT LIMIT,you have an accident with even .000001 count of alcohol in your system,your screwed,a lawyer is gonna play on the jury and your gonna lose,regardless of whether your legal according to DOT.Best to not have any alcohol in your system when heading back to work.I have an occasional drink,but never within 24 hrs of going back to work.Not worth the risk.Unfortunately thats how the legal system works whether your legal or not.

    Sorry cant get over this. Iknow i said "last post" . Im not driving for a large national carrier with a qualcomm in the truck tracking everywhere you stop and a dispatcher breathing down your neck which has nothing to do with alcohol anyways.i dont care if they might have their policies with alcohol consumption my CO doesnt have any. I just looked through a FMCSR booklet and it says something you cant be above 0.04 in a cmv cause it would be considered that the driver would be DWI. It is 0.08 in a personal vehicle,boat,riding lawnmower(lol), farm tractor etc.I asked a simple question. Even though I read through this I still cant figure out a correct answer. I got one from a DOT man but I just wanted to hear from other drivers cause Everytime I go to a truckstop loves,flying hook,ta,petro,pilot etc Thats all I hear on the radio is how everybody is enjoying some beer and talking about the lot lizards.IDK! just keep going

    Any driver drinking while out on the road is not a professional driver in my opinion,regardless of whether your on your break or not.I know everybody is grown and can make their own decisions,to each his own.IMHO.Doesnt necessarily mean its the smartest decision,just know it wouldnt be my decision.Think Ill wait til I get home on time off.Anytime a so called professional driver makes this decision while in their truck or on the road faces a risk of the consequences.

    Huh? The information from the little green bible has been posted.
    • Don't show up for work with a BAC greater than 0.04.
    • Don't use alcohol less than four hours before going on-duty.
    • Don't use alcohol while on-duty.
    • If driving, your measurable BAC must be less than 0.02.
    You did read it, didn't you? In the absense of any company policies that are stricter, you are bound by FMCSA regulations. How much simpler does it need to be?
