Fired for off-duty alcohol need advice!

    My employer wants all drivers not locally domiciled to take our breaks at their customer's DC.
    After ending my shift and going off-duty. I drove my car to a restaurant where I had some alcohol. After waiting what I considered an appropriate time, I returned to the facility to go to sleep.
    I was called in to the office and given a breath-alyzer. I had a BAC of 0.018 and was fired.
    I did not consume or possess alcohol on duty, before going on duty, in a company vehicle or on company property. The policy as written does not in fact include my particular circumstance. I was an otherwise model employee with a clean record, perfect attendance and 2 1/2 years on the job.

    Now, i am having trouble getting hired because all prospective employers see is: failed an alcohol test.
    Can they even do that? Pull someone in for testing when they are off-duty? And don't I have to be on-duty (per DOT) to be tested? They took my keys beforehand, so I had no access to qual-comm to even put myself on duty.

    Any advice on how to get another job or who might hire me is greatly appreciated.

    The question is, were you responsible for the load at that time? If according to the company you were, you are kinda screwed.

    No load, no assignment, no trailer - this was not work related.

    Hi dogtrucker, I feel bad for you. This is blatant BS. Sounds like the company has a "no alcohol" policy, no matter what. Sounds like lawyer time, unless somewhere it's specified clearly, no alcohol, if you even want to pursue this. I'd think "off duty" means just that, unless they're pulling a fast one with you having to stay at the DC. Trouble is, now that it's cast in stone, it's going to be an uphill struggle to get rid of it. And these miserable companies wonder why they can't get drivers. Terrible. If I may quote Pink Floyd, "All in all, it's just another brick in the wall".

    0.018 is nothing. Must not have had much. Why did they do this test. Was there trouble at bar/restaurant? What company. Make sure you come clean with all details if you want help. Someone here more then likely has had similar incident.

    Does your company have an office at the customers DC? Otherwise, how did they call you into the office to take the test? Do you really believe a customer would be ok with a driver having alcohol in their system on their property regardless of being on duty or off duty. Someone probably either saw you consume, smelt it on you, or you could have told someone and they ratted you out. The problem here is you were on the customers property and they likely have a zero tolerance policy.

    Could have had company narcs milling around. I know, a friend many years ago worked for a company in a small town that had a strict no smoking rule. She was seen coming out of an establishment downtown ( by a snitch, I presume) smoking a cigarette, and was fired the next day. America,,,freedom.

    Yeah, they have an office and the facts are not in dispute. Since it was the most minor possible violation of the policy, did not involve my truck or a load and was not work related, I can't believe no one would hire me.
    I'm just looking for some guidance here on how to get back to work.

    The problem is it's on the DAC. You admitted to violating company policy regarding alcohol, irregardless of how "minor" it may have been. The only recourse is to fight it on DAC.
