Go read the interpretation. That's the exact reason the FMCSA puts into it. For inclimate weather. I know for a fact you can leave in the morning and start driving and suddenly a snow storm can turn worse than expected. I've seen it happen enough times. You may have a forecast, but that's the only occupation I know you can be wrong 50% of the time and still be considered the top in the industry.

Drivers who are dispatched after the motor carrier has been notified or should have known of adverse driving conditions are not eligible for the two hours additional driving time provided for under §395.1(b), adverse driving conditions.

I do believe that is the point I am trying to make ralph.
You can't just "use it each week". There had best be some dang good reason you are using those two extra hours on-duty. -

The 2 hour adverse driving rule and the 16 hour exception are two different things. The 16 hour rule is used one day a week only after a 34 hour restart. You have to be a driver that starts and returns to the same home terminal every day. Or at least on the day that you use it. This is what the auditor Ralph is talking to is referring to. The 16 hour rule has nothing to do with weather or emergencies or anything else.

You have to scroll down about three quarters of the way down. 395.1(o)
And you have to start and finish at the same terminal for the previous 5 days on duty. -
My logbook was on duty, drive 15 mins, on duty 15 mins (load), drive 15 mins, on duty 15 mins (unload), etc all #### day long! Made me dizzy looking at it by the end of the day! -
