I am in South Carolina. Every farm truck I have seen in the shop does not have one. Some have been stopped by DOT and nothing was said. The current trucks I am working on come into the shop once a year for service and I pretty much do a full inspection on them to make sure they are safe. I just thought to my self if I am doing a full inspection I may as well put the stickers on and charge them. Just thought I would try to figure out what the law is.
How can the state determine wether a federal sticker is needed? -
The federal law states that any commercial vehicle including farm over 10,000 gvwr is required to be annually inspected. States are able to make their own laws in addition to federal law, but cannot be exempt from federal law.

We've always done annual inspections on farm vehicles where I am. Some think they are exempt, but they're not, it's a myth. Some officers might not be clear on the law and choose to not act on a farm carrier that doesn't have the required inspection.

If the vehicle never left the state, it would not have to comply with Federal regulations. Most states use the federal regs for guidance in how they have their regs laid out, but if there is a federal reg that is outside the normal scope of the state reg, then no compliance is required.
In the state of Texas, every vehicle has to have a State vehicle inspection sticker. These are also used as the Federal Annual inspection, so no seperate inspection haas to be done.
Each state varies in what type of inspection system they use. -
The South Carolina dept of public safety adopted the FMCSR title 49 sub chapter 396, so the federal annual inspection rules apply.

If I were to plate my F250 for more than 8,000 pounds, I'd need to have it inspected every 6 months....and that's a PRIVATE vehicle! There are years I don't even fuel the silly thing twice. As long as I keep the <8,000 pound tags on it, though, it never needs ANY inspections....so that's what I've got on it.
So yeah, around here farm trucks need to be inspected...anything tagged for more than 8,000 pounds needs inspecting....and needs that inspection twice as often as an apportioned commercial T/T which only needs 1 inspection every 12 months. Go figure.
