It is unless the top bunk is equipped with safety restraints. I have never seen a top bunk with restraints but I guess they could be installed aftermarket if they could hold up to the 6000 lb restriction in 393.76(h).
It's best as a trainee to bring a sleeping bag, blanket and pillow. You can throw the sleeping bag on top of the trainers bedding and sleep on top of it. Then you won't get each others funk!

I trained one harry legged kid to drive. I made him sleep in the top bunk when I was driving. Reason? Trucks almost never roll. If it goes in it's side, better chance of getting out. Less stuff like TV's to fall on you. The phone stuff, I don't know, I'm just an old Trucker

Sleeping in the top bunk while a person driving is a very good way to end up with a broken bone or concussion, I thought it was illegal too to do while the truck was in motion. Hands free is the only cellphone to be used by anyone now and most states have passed texting laws now which being a trucker is a lot more than even a car. And that includes trying to worry about what the qualcomm is sending in messages (most have that locked out when the truck is running) but it is annoying and a lot of times very inconvenient.
As far as reading a map that would be dangerous to; it is better to really study before starting out and write down distances and exit numbers if you have to inorder to keep track of where you are supposed to be going. A good GPS is good, but it is only a tool after you also study the map and directions to make sure the route is accurate. Don't get one that is for cars, they are not set for any height or weight restrictions and you could risk being in an area where you can get a ticket or rip off the top of your trailer.

Sleeping in the top bunk while the truck is in motion is against the internal regulations of many training companies, but we all know how well those regulations are enforced on the road.
That said, sleeping up there without restraints is a good way to get thrown out of bed in an emergency braking situation. And coming from that height is gonna be dangerous, no matter what you hit.NavigatorWife and bullhaulerswife Thank this. -
No laws from sleeping in top bunk but MOST companys do not want u up there when truck is rolling... If that truck rolls over u could be killed.. Even with a belt on top u still feel every bump more i did it for 9 months... cell phone while driving yes its against the law but people dont care into they get that ticket and end up paying it for the next 3months lol and lose there job.
