Re getting the word out

Hello MadinMichigan, thankyou for your words of encouragement. I am so sorry to hear that you have issues with your 401K plan! You are absolutely correct about them being in wrong on this; having taken the money that was supposed to go into the employee's 401K plan and then instead, redirecting it elsewhere! If anyone of us were to pull a stunt like that, we would get our butts hauled off to jail in a New York second! In spite of all of my efforts to try and put the spotlight on these folks, I am so doubtful that any real action will ever be taken against them. It would seem that they are fearless of any action being taken against them for the fact that they have gotten away with so much for so many years now. Well, it does not take too much effort to keep the letters rolling, and who knows; just maybe something will turn up yet. I have gotten all of my letters out today to whomever I can think of. We will see what happens. I contacted the court in Ill. Spoke with Alan. He did check to see if my husbands name was on the list of creditors and of course..it was not. I explained the situation with Alan and he said to go to [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. and their will be a forn to fill out called proof of claim. I think you have to make a copy of that and send it back to the address they give it is at 219 S. Dearborn in Chicago. I asked if once he becomes an unsecured creditor if he can attend the hearing on the 6th and he said sure thats what its for. So, we do plan on attending. I dont care of the Hartmans are there or not. I just want the employees to get what they have coming to them. I will be contacting the employees here and trying to get the word out. Everyone needs to get on this. Dont want anyone to be left behind. Keep in mind..we are going at this blind. I have experinced in life what one person is told another one gets different information. So if someone finds out something different, please let us all know. I am taking this avenue at this time. I dont want to lose what we have saved for for years. I believe the hearing is may 6th at 9:30 in room 800 is what Alan told me.

Re link to Bankruptcy Court Webpage

Hi Madinmichigan, I opened up that link you offered, and am confused about what it is I am supposed to be looking for. There are several links to choose from on the front page. Also, where was it that you looked to see if your husband's name was on some kind of list? I would like to take a peek as well, but in all probality realize my name most likely will not be on there either. Lastly, where is it this hearing is to take place? I probally should have been able to find this information on my own, but guess I too blind to find it...lol Thanks, Gary

I tried to manuever around also on the ill bank court site..ok here is how you get at the form..go to [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. and then over to the left you will see forms...once you put your mouse over that you will see National Bankruptcy forms go there...scroll down to form B10..copy that off, fill it in, and send it to them. The list that Alan was checking was the list of creditors to see if the employees were put on it and they were not. Hope this helps!

Just don't expect full payment . The court will dtermine what is owed to creditors , then look at the assets and determine how many pennies on the dollar creditors will get . If they have $5 milion worth of assets that only bring $2 million at auction that makes it worse .

Re Forms

Hi Madinmichigan, thankyou for your assistance. I found it and printed it out. Looks pretty complicated, but will have to examine it closely so as to not make a mistake. My wife works for a large law firm downtown, so if I get too confused, can ask her to get someone to explain it to me. One last thing; do you know where the hearing you spoke about is to take place? And you said it was May 12th? I really am considering making the trip. G

Be careful what you do by making yourself a creditor, by doing this you may remove yourself from the employee list. Employees should be the first to get paid.

Just remember each creditor will get pennies on the dollar for what they are owed by MSXN.

so is it true that the bankruptcy court looks at the employees first? Guess maybe its time to go talk to a lawyer huh?

Someone had better check on that point. Am I correct that employees are unsecured creditors and are at the bottom of the barrel? Don't know this for a fact though. They should be first but are they???

Doing follow up with FBI....need some numbers?

I contacted my local FBI office a couple of weeks a go. The agent I spoke with asked several questions to see if this is something they need to investigate. Once the agent heard the story she seemed to think this was something they would handle.

Tomorrow I am going to follow up with this agent to hear what they have decided. I was not aware that MSXN had also stolen every ones 401K.

Does anyone have a ball park figure as to how much these crooks have gotten away with in total? Any idea at all? I was estimating some where around 4 million in insurance premiums? Now with the 401K thievery, who knows?

I would like to have some kind of number to give to this Agent while talking with her.


In my initial conversation I told her that the damages due to the insurance fraud along with the lost wages could cost the employees more than 20 million dollars.

I have contacted news agencies, politicians and law enforcement till I am tired of it. Demonstrating at the court house and at their home office is a great idea. I am tempted to go to my local police station and tell them I have been robbed and that I am a victim.

I will post the results of my conversation with the FBI agent.

A Federal Prosecuting attorney could pick this up also..so contact them too!
