I quit Mark Services without notice because they knowingly sent me on a 1300 mile trip with a reefer with mechanical problems. They also were ignoring the write ups I was making on the truck noise when under a load. They had already deducted $200 from my paychecks . I went to pick up my first of two checks they owe me and Mark Winter, the owner, told me that because I did not give a notice that he was holding my checks for 45 days. One check was for $700 and the other is about $900 plus the $200 and the guy is refusing to pay me back $1800. Has anyone ever heard of such a thing? Anyhow, the State of Nebraska Department of Labor has told me this is illegal and their are fines they can levy against him.

giving notice is just a courtesy not a mandated behavior, NOW paychecks are covered under several laws and holding pay hostage just because you were a little discourteous is not allowed. I hope you have records and proof of pay owed because I'm sure the jerkoff just wants the 45 days to figure out how to screw you out of your money.

I just googled them. they are members of the BBB. file a formal complaint with them, and have all your evidence available to show BBB if needed.

File a petition with small claims court and have a Judge rule on this if you don't receive payment, but you have to have the documentation to support your claim.

Make sure you have copies of the BLs
.....then call a lawyer ,....this has caused hardship on your family right ? Sued them on family hardship, mental anguish
Triple what he owes you ,too bad you don't have the truck in possession ,you could hold his truck in escrow until you are paid in full .....that is the Law !!!! -
I don't have copies of the bills but I have papers describing the loads, logs showing the miles. State of Nebraska Department of Labor asked me for documentation, which I gave them a couple of weeks ago. Today I called them. The girl working on it is on vacation. The guy I talked to said he can't look at her files. I thought that was strange.

The State of Nebraska Department of Labor did recover both checks for me and I received them on September 9th.
