I posted a rant about being written up for a tag light. got challenged by a scalemaster on here. respectfully though. it's the same everywhere, though in some states it's worse for sure.

I'm surprised you revved it that high for him. Anyway, looks like it will be easily fought and dismissed. Still a huge waste of time and money anyways. Seems like they win even when they don't win.
ramblingman, MJ1657 and rank Thank this. -
you might want to turn you high idle screw in to get it within a reasonable range if you want to.
some kind of break over limiter should work, or an air cylinder on the A/F diaphragm screw,
AND there were a few PEEK engines that still had the B crank.rank Thanks this. -
Knowing what I know now about the governor, I will refuse the test next time. It will probably be the same EPA guy.ramblingman and nonsense007 Thank this. -
icsheeple Thanks this.

Who in their right mind would tell a guy to just rev it as high as it will go?? I really hate the fact that we sometimes have to understand their job better than they do to survive out here.ramblingman and rank Thank this. -
I had to shake my head at their use of the term "throttle" in a diesel.icsheeple Thanks this. -
Not real familiar with Cat, the O'l Detroits could have a fuel delay mounted under the valve cover that eliminated quick fuel response, was Detroits way of "eliminating smoke". I've made an adjustment on the O'l 855's with an Allen wrench and do the same thing. Bound to be a fix other than running over the dipsh1t....

So my court date was Sept 25 in Utica. Couldn't fond a load to get me there so I called the court and they got me in touch with the DA's office and we made a deal to "handle it by mail." I am supposed to mail them all my "documents".
Anywhoo, I thought one of my many defense arguments would be that the EPA charged the driver of the truck (me)n with the emission violation instead of the owner (a corp). I was certain that the ticket should have went to the owner of the truck. The actual law (217-5.4) reads:
"No person who owns, operates, registers, leases or rents ...............shall operate said vehicle, or allow to be operated........"
I have looked high and low in the web and I cannot find a definition of "operator" as per NY law.
It sure sounds to me like the state of NY Dept of Environmental Conservation can charge the driver with the truck failing emissions ($700). They dang sure charged me I know that. -
So did you enter a plea.....?
Or just ask for another date..rank Thanks this.
