Exacta-mundo! I believe that if a Dr. signs off then I would hope you're good to go. As Roadmedic says if you have an accident and the investigation reveals an undisclosed prescription I believe you would be up Sheet Creek without a paddle!

Your medical history is what you state on the long form. There is no 1-800 # that a truck company can call and find out your info. I'll explain further. YOU go to YOUR Doc. He has a "file" on you, pertaining to YOUR past visits, with reasons you came there and what he did to "cure" you. This is your "medical history". It is private and never leaves his office. He cannot share it with anyone. So, explain to me how a truck company can "verify your medical history". There is no "medical history" organization floating around out there.

Failing to properly fill out the medical form, you might want to review the wording. -
Listing prescriptions is so the Medical Examiner can determine if you are fit to drive a CMV. I hardly see how not listing your Viagra on you long from is going to open you to lawsuit....it simply is not relevant. So the day before you took your physical you quit taking some prescriptions. (Not a disqualifier.) The day after you started them back up. (Also not a disqualifier.)
Where is the statute that when you start a new prescription for ANYTHING that you have to get a new physical done? -
It is private unless you give your doctor permission to release the records to an employer. When you sign the job application there is usually a clause in it like this:
I acknowledge that I will be required and agree to submit to a physical examination and controlled substance and alcohol use testing and authorize release of my results and all prior medical records as part of (insert company name here) evaluation procedures in deciding whether I should be offered or continued in employment/lease.
This is taken directly from a trucking company application. It is no different than any of them. Check out the applications you have submitted. Secondarily, if you are involved in an accident which results in legal action you can bet your bippy those records will be subpoenaed. OK, so how does a trucking company or anyone for that matter know who your Doc is ? What if you don't get sick and haven't been to a Doc in 20 years ? What if you've been to several various Docs over the years because you've moved/changed employers that have a different selection of Docs ? What if you can't remember what Doc you went to 10 years ago ? I firmly believe sooooooo many drivers shoot themselves in the foot by volunteering way too much information needlessly. Question from prospective employer to prospective employee : What is your Doctor's name/address etc ? Answer : I don't have a regular Doctor. I just use clinics for my DOT physical. My last physical was ABC clinic 8 months ago. I don't remember the previous clinics.
As far as getting sued, even a sharp lawyer couldn't find out who your Doc is, unless you tell him. What does a lawyer do, contact every Doc in the USA and ask if he has patient so-and-so. -
Let's say someone was involved in a fatality. First you will be drug tested. Then the suing lawyers will obtain a court order to get your medical records.
If it was me doing the investigation, I would work backwards from the pharmacies. The majority of patients will use the big pharmacies and one can even check the smaller pharmacies in ones town of residence. It wouldn't be that hard at all to find presribing physicians and where one has been treated. From there they can get more info on you because you told that doctor some history.
I would always be honest, but don't volunteer info if they don't ask. A simple lie or ommission can make all the difference whether you walk or lose everything you own.
Valium and Xanax, which I don't agree are excluded from DOT forbidden list. Taking as prescribed in low doses they are no biggie and no company should be concerned. It's when they are abused by many is when they are a problem. Flags won't fly unless you have major medical problems like diabetes, nuerological or cardiovascular problems. Even at that, most can get waivers.
If it was me, I would play the legal game to CYA and have peace of mind. I know many dodge the bullet and get away with it. But if, just if, one can find themself in a courtroom. All it takes is one idiot running a red light and your life is turned around.Female Driver Thanks this.
