The truck driver might not be criminally liable but if the victims family takes him to civil court the jury will be asked if the truck driver's action was negligent and did it play a part in the person's death. If the jury says yes then he is screwed. Putting your future in the hands of 12 strangers is just not worth it.
Stay off the shoulders if you can help it.
