I know, its been asked a thousand times on this board, can I 1099 or do I have to be an employee? If any of you still THINK you are all knowing and its settled, fill out this form http://www.irs.gov/pub/irs-pdf/fss8.pdf and let us all know how it goes.
Stop the internet or truckstop lawyer stuff. That form will settle this ongoing mystery once and for all. FYI, I did this four years ago and was told (with 100% black and white certainty) that I MUST W-2 my drivers.

Could ya'll please tell me whats good and bad and what do I have to worry about if working as 1099. I just got a call (job offer) that sounds very interesting and making me change mind about going O/O and putting that on back burner couple years. He pays 1099 and takes out 130 a month for Work Comp. I have no clue about this 1099. Please help. Thanks for your time.

130.00 isn't work comp. Occ insurance instead.

Occupational insurance. Unlike work comp it has a finite payout limit and more restrictions. Had a couple of O/O's with OOIDA occ ins. Other than paying for the medical(ins doctors 40 miles away)the lost wages were minimal payments.

Well what can I say. He said exactly it was a deduction and ONLY deduction they take out of pay and for Work Comp. I'll speak to him again and ask.
