humm i think this is the best place for this post its more of an update though of a very unwanted personal experience i had at 11:08pm last night...
I was parked at the Angola Service Station Just South of Buffalo NY, on the West bound side when i was awaken by a police officer... i had been asleep for about 6 hours so i was having enough of a hard time trying to make it to the door.. then he informes me that i am in Violation of New York's no idiling law so i told him i'm sorry had been up for 14 hours when i parked my head hit the bunk and that it was cold out and i was running the heat... so he appriciated my gesture and gladly wrote me a Ticket....
1st off Idiling is a Moving Violation if worded as such: Disobey Traffic Control Device..
2nd AS of September 1st 2006 it is NOW A Criminal Offence In New York
3rd Some Counties and ALL of Long Island under the new law Have Mandatory Court Apperances.. i hope that isnt the case for me..
The Fine according to the Driver's legal plan is arround $55.00 but as the lady on the phone told me that was before the new law so i am the 1st to be tried under this new law in that court but they had been successful in 8 previous tickets for the same offence.. so i guess i will keep this post updated on how the trial goes

That's a bummer! These are the temperatures as recorded yesterday at Buffalo:
Mean Temperature 57 °F / 13 °C 58 °F / 14 °C
Max Temperature 64 °F / 17 °C 67 °F / 19 °C 82 °F / 27 °C (1908)
Min Temperature 50 °F / 10 °C 50 °F / 10 °C 36 °F / 2 °C (1887)
All I can say is just watch that outside temperature. -
o ya i forgot there is a Exception to the law... if it is Below 25 Degrees outside then it is ok to idle your truck.. but if its 130 out you better off preying for a cool breez

I came down sick - almost killed me - with an outside temp of 85 or there abouts when my A/C broke down - inside temp was over 100 with windows down to a safe level and upper windows open. As for 25, that's a joke - they must want a bunch of frozen truckers - 32 is'nt even a safe limit - imagine the Carbon Monoxide/Dioxide build up in the cab without air circulation.
Let the Pollies and Management suffer what they expect us to and see how long they last!? -
When's the last time you saw a policeman or lady not idling their police car. Sometimes even at the doughnut shop. If you have an animal in your truck you can idle your truck,but if your alone you can't, that's the loophole I have read and been told. Some drivers are getting pets to throut the law,i understand,can't blame them.

The best part is the "Angola Service area" is like 50-60 miles from any city, closest being buffalo.
And if they wrote you for "failure to obey traffic control device" than it is a I believe 2pt violation.
ALSO THE $55 that DRIVER LEGAL PLAN SPEAKS OF, is the state surcharge, the fine can be expected to be from $80-$150 + the $55 surcharge.
I HATE NYS!!!!! I live there and love living there, but the law enforcement community is sooo driven by making revenue for the towns and state. Crime is overtaking even the smallest communities, yet the police are writing tickets for idleing, and other minor violations instead of doing something proactive to tackle the rampant drug use in the smaller communities.
I have many friends in law enforcement, and they all seem to have the same thoughts, "my boss wants traffic tickets, so i write them."
At the same time my friend also says that the rural county he works in has an out of control heroine, meth and coke epidemic.....
WE NEED THE PEOPLE AT OOIDA and OTHER UNIONS to start fighting for what is right.
Also, most idleing laws can be voided to you by one of 2 things.
1. Pets
2. Doctor "note" or statement stating you need to be in a temperature controled envorment.

additionally....
Ok the temperature in most areas is at extremes 60-70% of the year...
1. Any daylight temperature of 70 or over in most cases will cause the cab of the truck to heat up beyond any resemblence of a comfort zone.
2. Colder temperatures, while easier to handle, via sleeping bags etc, still do not address the issue of air flow, trucks in truck stops are parked next to eachother, thus getting a breeze in the vents and upper bunk windows, is ususually easier said than done.
3. Opening windows in the doors is not a safe thing to do anywhere, you in most cases would not leave your door open in your house. Why would you leave yourself open to criminals in your truck.
4. People ususually sleep best at a certain temperature, for all it differs, but everyone has a comfort zone where sleep is best. I sleep best around 68, and if the auto idle for some reason malfunctions, I wake up, thus possably driving tired. After I sleep for 4-5 hours if i am awaken it is impossable to go back to sleep.
5. I think these regulations will force the hand of companies to provide idle air and or APU's. I personally would love to have an APU, and I think in the scheme of things the companies would save $$$$ over the long run having this.
Most people ignore idle laws and simply fight the tickets, most jurisdictions will plea any violation down to somethiong that guarentees the local court the most $$$$.

Stop hauling freight to such places. Once the communities can't get their food, toilet paper, lumber, milk, ect ect ect they might hold their ellected officials feet to the fire to act more grown up.
I run a fairly large area of the country but it doesn't include CA, NY, NJ and points farther east/north. Except on very rare occaisons.Wiseguywireless Thanks this.
