Does anyone know if it is legal to pay a driver by the load in NJ? I can't seem to find the answer anywhere.
My employer pays me $1500 a week and requires 16 loads a week. But on my paycheck I am payed for 40 hours of reg time and 10 hours of overtime.
I received a memo today requiring now 18 loads Min a week and no extra $ no matter how many more hours this adds to my day. Just wondering if this is legal and what I can do about it.

I'm curious, Is your husband paid by 1099 ? or does the employer take out the FICA ? The answer might help your question.

I was kind of thinking on the same lines as rookie.
So my other question would be. How many hours a week is he actually working now? And could he do 18 loads in the 50 hours he is being paid for?
If he is an actual employee. Then they can technically put down any terms for work they want, up to a point.
But he must be compensated for the work he is doing. So if he is working more than 50 hours now, then yes, there is something he can do. Since that is illegal under the labor laws. That he falls under as an hourly employee. -
it sounds kinda funny. sounds like sallary $1500 but recording it as hourly.
I am on sallary and my time sheets will show both reg and overtime but pay is the same. requierd 48 but often more like 60 same pay. but god forbid i put in only 45 lol
in todays workforce more and more is put on us. for the same pay. it is everywhere. $1500 a week is darn good money -

still should be up to dot 70hrs in 8 days 34hr reset correct? or does that not apply to local runs?
i useually work 6 days some longer than others 8-14 hrs 65 hrs and make half that. at least truckn i can earn a liveing I hope. I have not had a raise in 3 yrs. time for a change -

Local drivers under the 100 mile exemption have a few different rules.
One of these would be the reason for the hourly pay.
Because for these drivers they have to show a time card that does not allow the driver to drive more than 12 hours per day 70 hours per 6 days. They have a 24 hour restart.
This is why many local company's will run Monday-Friday and half a day Saturday. -
He is not paid by 1099- it is a company truck. He leaves th ehouse # 1AM and most dyas does not get home until anywhere between 5-7pm depending. So, needless to say 50 hours is a joke!!
