As anyone who searches my post can tell I have NO love at all for
CSA 2010 and any of the minions who try and torture us with it.
I have given great thought and did some studies and even a little field
testing with my what I think will slow down the pace with which they bombard US with this useless system. Before I post any of my findings and results from actual use of said findings, I was testing the waters to see if there is any real interest by members here? The methods and practices I use won't help you any at all if you don't know how to keep a logbook or run a junky truck.
But they have helped me when confronted by some officer that thinks he can run all over me and write violations just to make it appear he's working.
You do have rights no matter what they tell you and they have to follow the rules or suffer the consequences.
Your job to remove unfair violations starts at the momment the officer signs his name to the report and yes it can be changed right then. Thats the best time to do it before it gets caught in the eloctronic sewer of the FMSCA.
After that it becomes harder but can still be removed, I have done it before.

But I wlll post where I started at when I was tired of them screwing with me.
First thing you need is a copy of the green Regulation book in the truck with you. You need to know exactly what is encompassed in the different levels of inspections, it will suprise you. If you are online you can visit the FMSCA site for a easier to read version. After you know whats there you will see that not one of them is doing a complete level one. But they are claiming to? This here is a clear violation of law. They can't change rules to fit their need.
If they can write us up for falsify a logbook, why can't they be wrote up for falsifying a police report?

This is the statute from ohio it's (A)(7)(G) applies Did I mention I don't like ohio?
I have had them go as far as ask to see my spare fuses and bulbs.
Did you know you're required to have a least one spare fuse for the one in fuse panel? Most have breakers now.
I did have spare fuse too that ole boy was pissed he could't get that violation. -

I filed a challenge one time via DataQ and DOT reviewed the inspection, realized the officer was wrong in his assessment and faxed me a "clean" inspection to replace the "dirty" one. Then, I had to spend days calling FMCSA for months, to make sure they had removed the points.... and although FMCSA guy on the phone told me the points were removed, I am still struggling with myself to pay $10.00 to find out if they really removed the points. This is another way for them to make money. They create this ridiculous, unrealistic, damaging rating system and them charge us to get our records.
End of last year, got a Roadside inspection because one of my headlights was out... It happened in transit while going west, at noon, on a bright sunny day, there was no way I could see one of the lights had gone out.... I had a spare bulb and asked the officer to let me replace it. Also told him I was going to stop at my destination within one hr and was going to do another inspection and would be able to detect the problem and fix it before dark. So, that wasn't in any way a hazard and would never put public in danger. But officer didn't reason with me, just gave me a warning/violation code 393.9H... I showed him my CSA guide book, and explained that would give me 18 points on my CSA card for the first year, then 12 on the second and 6 on the third.... and that was a too high of a penalty for something that wasn't affecting safety at all. He didn't care, not his problem.... I don't think I can win this. I used that DataQ again and asked FMCSA to reconsider the points. But all they do is to forward the challenge to DOT... but this time, there's nothing DOT could do because according to the code, the lights must be working at all times. What I really wanted would be for FMCSA to lower the points or dismiss any warnings. But, for that to happen, the whole rating system has to be changed. And how do we change that?? I am willing to participate in any joint effort, if there's any. -
I don't understand these company drivers saying they don't care???? Well, they should. Do they think that CSA doesn't apply to them??? So many companies out there have a very high safety score and DOT has its eyes on them.

Heres how the challenge works they send it back to the state that wrote the inspection report.. Thats about like giving the inmates the keys to the jail.
Now the way I would probably handle the situation you described.
For you to get a headlamp violation you would have to have had a level one or two done? I beat he didn't check everything, like steering wheel free travel?
or protection valve? There was something he missed probably lots of things?
When I was handed the report first I would make sure it was signed indicating the inspection was over and certified correct by officer.
I would look it over and not sign and say I had a problem with it and tell officer I was going to my truck to check the code out online on the violation I had been written. I would look it up and decide if I could invalidate his inspection then, I would also look up state appropriate law on filing false reports. I would then go back and ask officer to have a supervisor to come to the scene that I have a complaint on officer. While in my truck I would have made a copy of the officer signed report and hide it for safe keeping.
When supervisor arrived I would tell my sdie of story and ask for report to be corrected then and there. IF not I would ask to have a written report taken on my complaint against officer and if a magistrate was available to hear my complaint and consider arresting officer.There you have made a official complaint if nothing else and started the process of maybe getting the officer unemployeed. Sometimes if they know they have done wrong they will change the report. I have had that happen once. I also record or video them at non-work as I call it. (I don't let that be know though) thats for court.
Just bear in mind once you start in on them you have to finish it.
Most people are to affraid to stand up.
I think the winning is well worth it or has been for me evertime I fight them.
Never used a lawyer either.
