The problem is drivers don't know any better so they allow it. Me personally when I have been awaken by DOT in rest areas in Ohio I politely tell them to sign my log book stating they interrupted my mandated 10 hour break before I move to the front of my truck. I have yet to be inspected while parked in a rest area.
I even told a couple of them they are more than willing to come back in 7 hours as my sleeper break would then be over. They say I better be gone before they get back and both times I was already down the road. Just because they say they want to inspect you while on your 10hr doesn't mean you have to allow them too.mje, CondoCruiser, Bumpy and 4 others Thank this. -

I'm not going to state if it is illegal, or not. However, I do know the Feds frown upon such practices and will chew on the state's officials, in charge, for allowing such.
