Drivers need to understand that taking a 34 restart is NOT mandatory even under the new 168 hr rule. You can run on your recap if you want.

Local drivers may need to know the new stuff to! Local drivers need to know the rules if they work over 12 hours a day as well because if you work more than 12 hours a day, you should be submitting a paper log for each day over 12 hours.
You also must know the recap rule for your company 70/7 day or 70/8 day. plus the new stuff!
I woulds say, you focus on the one's I stated, its basically 2 rule changes but several different examples for each change to hopefully make hte driver understand the changes .
You do hvae it easier though. I am not sure if local drivers have to comply with the 30 minute break. I have to research this.scottied67 Thanks this. -
Yes that's true, restarts are not manditory at all!
What i want to know is if the driver gets a 34 but choses not to use that 34, can they ignore that 34?
I thought I read they could. They have to select which restart they chose to use! However I have to research this everyone please do not take that to the bankNavigatorWife Thanks this. -

Danny: you would not be able to start the restart until Saturday, therefore you would have to be off sunday morning 1-5 and monday morning 1-5.
I mean to say Saturday and Sunday. Count over 168 hours from the beginnning of your last 34 hour break.
Example # 9 states the below
GREAT QUESTION FOR ME THOUGH
This is an example of the new restart provision. After June 30, 2013, a driver may
not take an off-duty period to restart the calculation of 60 hours in 7 consecutive days or 70 hours
in 8 consecutive days until 168 or more consecutive hours have passed since the beginning of
the last such off-duty period. In this example, the driver reaches his/her maximum 60 hours (on
duty and driving) in 7 days on Friday (1/7) and therefore can begin a new 34-hour restart starting
on Saturday (1/8). This is because the 168-hour period is counted from the beginning of the last
prior restart, which was on Saturday (1/1). The restart must include two periods between 1:00
a.m. and 5:00 a.m. as well.
*The compliance date for the new restart provision is July 1dannythetrucker Thanks this. -
I usually get home on Friday noonish with about 10 hrs left on my 70 and leave Sunday morning again. Even under the new 168 hr provision it doesn't bother me because I can just start whenever I want on sunday and run my recap all week.

I am not just focusing on drivers on e-logs. I don't know if there is going to be an option for a driver to select to take hte reset or not.
I just don't see why if I happened to be sitting waiting on dispatch for 34 hours but have 50 hours on my 70, why use the restart provision when I didn't need it. Maybe if I need it later in the week, then I can take it and then it starts from the time I actually stopped working instead of the beginning of the last 34 hour break that I didn't want or need to take in the first place. Meaning he driver would be down more hours because he/she didn't get dispatched. Just my thought, maybe it won't make a difference but I believe it will for those drivers stopping after 1:00 am in the mornings.
sorry guys, I thought by clicking the reply in your msg would show who I am replying to but just discovered that's not true, right? they changed this site since I was last addicted to it l.o.l -
As long as you didn't need the restart you are correct, however if you stop on noonish on Friday, then you will not be able to leave out until after 0500 on Sunday. Then anytime after that you will reset.

What you need to do is figure out, do you really need a restart? I would say you probably have needed it but
maybe not. Do you work 70 hours or close to it?
If you work 50 hours, then you probably do not need a restart anyhow. It just depends, this is giving me an idea of a question I need to be prepared to answer and have a log book example. Exactly why I opened this can of worms
I haven't read all examples yet though l.o.l.
