When I was leased to a company, they did this(Virginia). It was an all O/O company so I think as long as a truck(o/o or company) has the specific companies name that owes them $, they will hold you, whether its legal to do so or not IDK...

    i don't think it's legal.

it's the driver that got the ticket, not the company. it's the drivers responsibility to make sure loads are legal.

kinda chicken sh-- if you ask me. driver don't pay the ticket. suspend his license. guess that don't fly anymore.

It doesn't matter if it is an O/O or company truck, the lease that is signed makes the truck part of the authority to operate and hence is viewed as one in the same of the fleet.

What puzzles me is the idea that there are "rights" involved, you have limited rights in this industry, it is regulated and you can't do much about it. I cringe when I hear about civil rights, no one forces anyone into this business and when you enter into it, you need to understand that your responsibility is not to get away with everything but to do the best you can do to conform to these stupid and archaic regulations. Of course we should be striving for something better so we don't become targets but come on people, we are our own worst enemy when it comes to this stuff. Look at some of the junk and marginal drivers we deal with all the time, look at how we are preconceived as overweight slobs who have to "qualify" to drive through a money making venture called a physical - how many of us actually drop dead while driving and kill millions of people every year?

I have had a lot of problems with Ohio and try to avoid the state but it is hard to do, seeing it borders half my own state and I have a customer to go to for one of the companies I service. A few weeks ago I got pulled over just inside Michigan coming out of Toledo one day and the officer wasn't nice, he tried to find something on the truck to write up I was driving (brand new Mack), and finally after almost an hour he decided to write me up for ... get this ... windshield washer nozzle defect, it wasn't spraying on the right side properly. I signed the paper work he handed me, handed it to the VP at the company telling him what to do, stood there while he faxed it over to the state and went home.

The only problem with doing that is he would more than likely get a hit on his DAC for abandonment.

    A washer nozzle??

It is getting bad out here for most of you guys.......

i dont wanna de-rail this but.....Notice how the "Good" carriers arent messed with? Unionized Carriers, Foodservice Carriers,State and Federal Class 8 Tractor-trailers, Not for Hire Major Distribution carriers,

Notice That? its because its Harder to 'destroy' a more firm foundation when representation exists.

These DOT men and women Prey oin the weak..And the weak just happen to be the hardest working folks in this industry..(owner-operators,and underpaid irregfular route carriers)

We are NOT going to turn this thread into an argument over weather or not this industry should be unionized.

Generally in VA, an overweight citation will be issued to the carrier and not the driver. This is due an overweight citation to a carrier being a civil citation that can be paid online, and an overweight citation to a driver being a misdemeanor charge that requires a court appearance.
