Lots of news on this subject today. Apparently Carb is considering delaying the existing start date until 2015. I still want to know who is responsible for the fine: Driver or vehicle owner?

Today, April 24, a friend of mine with a 2006 Columbia Series 60 14 L was in Otey Mesa CA in the nest of the hundreds of warehouses there servicing the Mexican freight movements. CARB set up on an empty lot, pulled in every truck. He was given a warning, and told in no uncertain terms his truck was not legal in California, and if that VIN shows up in California again the fine will be north of $10,000. He asked about the 1000 mile low use vehicle exemption and was told it did not apply to his vehicle or his companies operation.

Ok I should expand on the CARB meeting yesterday. Hey Stump, if you go to the CARB website the overview and video are there. There were six amendments to the truck/bus rule that were up for discussion. First was expanding some exempt counties in far northern california and the sierra mountian foothills. This is for CA registered trucks only and you must run 80% of your miles in those counties.Second, was for small fleets. (3 trucks or less). Your first truck has to be CARB compliant by 7/1/14. Second truck would have to be compliant by 1/1/17. Thrid truck by 1/1/18. Basicly extends the compliance on the second and third trucks a year. Third amendment was the biggest fight! It says if you can prove that you cannot afford to be CARB compliant they will give you an extension until 1/1/18. Many trucking company owners and industry professional testified before the board. Including the owner of Gardner Trucking,Valley Farm Transport and others. 100 to be exact with five hours of testimony. They were saying they have spent millions of dollars to be compliant and now changing the rules to give people who have ignored or wont raise rates to be able to afford to be compliant, would be wrong and lawsuits have been threatened. Many of the aftermarket DPF producers were on hand also because people are saying the products are unreliable. They said most of DPF faliures are due to other engine problems and truck owners who do not keep their motors in tip top shape. Fourth amendment was for low use construction trucks. If you run less than 20,000 miles a year it will delay compliance from 1/1/15 to 1/1/18. Fifth amendment would be the low use law. If you run 5,000 or less miles a year you can delay compliance until 1/1/20. Sixth amendment would alow livestock trucks and AG specialty vehicles and delay complaince until 1/1/20

Bootom line,if you are and out of state truck you need to be CARB compliant right now

the state knows that if they start citing, it will accelerate the court case by the OOIDA to the SC (which will affirm the federal mandate and slap California hard) and spur more individual suits in the states where the owners registered their trucks which will be out of her hands of the 9th circuit court and California.
