each state in these UNITED states is supposed to have virtually complete autonomy to do as they please
of course, that has its own set of circumstances, but that was the way it was supposed to be

Furthermore the constitution also states there is no limitation on travel between or within the states, which boasters the idea of a limit to privileges of any state where they place strict limits on travel of any citizen for any reason. The state of California can cite someone for driving a truck but then the citizen's rights of free travel are above and beyond that of the state and the citation is in effect null and void by the constitution.EZX1100 Thanks this. -

OOIDA contends that the CARB rules violates the Commerce Clause. The Commerce Clause prohibits state laws and regulations that discriminate against interstate commerce or unduly burden interstate commerce.
I'm not holding my breath and betting on their winning although I do think that they (and you) are correct. -

It's bound to happen ,
Gub'ment is ultimately setting it up to where only the mega carriers can survive ,
it gives them more control over "public safety" .... ( air quality falls into public health )

Can't see it happening ... How can they just announce that your asset being your old truck that is earning you your living is now effectively useless and therefore worth $0..?? If they are truly that hell bent on getting everyone on new trucks and new emissions, why not just close the loophole for glider trucks to be built ... say any new truck bought has to have the emissions crap on it, and whatever is on the road today can just continue operating until they all eventually die ... Not to mention what it would do to anyone who is operating a used truck lot ...
