Watch out!!! Cleaning the truck or polishing is technically "On Duty Not Driving"

two things come to mind, first is the personal use thing, is that bobtail or with a trailer? I am told often that is bobtail only, can't use it with the trailer. The other part of that is the FMCSA regs, or better put the guidance isn't binding for law enforcement, one state or a few can have stricter laws on that subject and say no beer in the truck period without a BOL and permit.

Second thing is truck stops are not private property, they have public access and are considered open property. The truck stop company can claim that it is private because they are in control of the property but it is not private for any one else. If you don't believe me, check with a lawyer.

When I'm home and my state DOT is holding a safety seminar for trucking companies I usually go. I get my ISS score lowered for attending. They always have a main topic but then it's opened up to anything. The 2 most major topics are drinking and rights. We've been over this so many times.

It's funny to hear them launch into our rights especially from the enemy's point of view. Best one is can I sit in the passenger seat. You can say no but if you say yes anything they see is fair game. If they ask you to get out of the truck take your keys and lock the door. They can't go in without your permission, search warrant or probably cause.

You should all belong to OOIDA. If DOT violates your rights OOIDA will rip them a new you know what and they don't give up. Ask Minnesota.

Then how are they able to go in to a truck stop and write tickets for parking in the fire lanes without permission from the owners???? Because they do and those tickets stick.

Keep an eye out once you join or keep an eye on their web page till then. They have deals. I got an early renewal notice a while back and renewed real cheap for 3 years instead of one for an extra $25 or something.

OOIDA has a ton of top notch lawyers. If you get screwed somehow by a DOT and OOIDA gets involved they don't settle for ok, we were wrong. They keep going for more including loss of income and other fees. They are a bunch of pit bulls.

    SMTatham and icsheeple Thank this.
