Yes, driving a CMV without a valid CDL in your possession is a "serious traffic violation" as defined in table 2 to §383.51. HOWEVER, if you read the footnote attached:
In other words, yes you'll get a ticket IF you are caught. Send (fax, e-mail, etc.) a copy of your license to the agency that wrote the ticket and it gets thrown out. If you know your license #, the cop on the side of the road (with computer systems they have today) can look it up and verify that it is you and that you DO have a valid CDL and won't write the ticket.

We've been running spot market loads all year, so not dealing with our usual customer base, and so far only 1 customer has asked to see a drivers license. Did they forget to tell the shipper and receivers about this new rule, or law?

Someone must have forgot to tell the shippers and receivers. I haven't been asked for my license except at ports where they always have asked.

Having a license number to give an office does not verify the person giving the number is the holder of such license. Unless you also have a picture ID to prove your face matches the name of the license number given.
This happened to me once and I had to wait in a weight station until a copy was faxed from my office. No ticket issued.
You should take the shortest route home and get another license.

Why would anybody besides law enforcement or your employer need to see your DL...It it just a case of S/R wanting to see ID ??

I think so. I was told by a few it's "law" now. Don't ask.

~ Deep, heavy, SIGH~ No such law exsists, some shippers and receivers request/require you to show ID.

Also note that alot of jurisdictions will not accept a photo or fax copy of tour CDL, on the road.

The reason being that they say it could have just been recently pulled by a legal action and not caught up in the computer yet.

They will issue a citation and may not let you proceed with driving a class A vehicle.

You would have to make a personnal apperance in court with your new copy of your CDL to get the citation dropped, even then the court may not totally drop the case because you were driving with out a valid CDL in your posession at the time.

Read the regulations. Same one that says it is a serious violation to drive without it in your possession also says providing proof that you were a valid CDL holder at the time of the alleged infraction prior to your court appearance or fine payment WILL result in a "not guilty" verdict. No DA in the country is going to go to fail to drop (thereby choosing to go to trial) on a matter the law tells him he cannot win. It really isn't all THAT big of a deal, provided you DO actually have a valid CDL for the type of vehicle you are operating.
