Interesting per diem question

    Hi all,
    A week or so back, I got stuck in a storm as I came back home. I drive with a sleeper cab; but the main purpose of having it is in the very rare chance of a storm and my getting stuck in it. I parked it for the night, went to bed and woke up and got going the next morning. Im on a dedicated run so Im pretty sure Im not on a per diem plan. How would this work for my taxes? Im not totally sure how this changes things.

    Any day you have a log showing you spent the night away from your home, you can claim the DOT Hours of Service provision for meals. I believe the standard rate is at $52 a day, which you get 80% for 2007.

    Another thing I read recently, is that you will be allowed to claim half days this year. So basically, any day you work and have a log for, you can claim the deduction.

    Thanks for the info. Do I need to have any reciepts or just log the overnight time in that other town to get the per diem? Meaning, do I need the reciepts to get x amount or will my logging the overnight be all I need and I'll get the 80% of the $52?

    Do you have more info on the half days as well? I havent heard of that, would like to find out more about that.

    You can do it either way; by saving your receipts, or producing your logs...BUT you cannot do it BOTH WAYS. You have to use ONE method OR THE OTHER in determining your deduction.

    Technically you are correct. However, the actual figuring is based on the percentage away from home. If it over night only, it would probably be closer to half of the amount or 26.00 per day.

    I don't think I stated it clearly enough. Half days will not get you the full deduction. I believe they allow 50% of the total allowance for that.

    As far as receipts go, why fuss with them? Just count your log days and claim your allowance. I'm pretty sure that 95% of us will come out ahead with their allowance, unless you're hitting Outback for dinner every night!

    What is with the half days? I havent heard of this before. In my case, I left on a Friday (I think)...forced to shut down x miles from home and parked it for the night. Came back home Saturday...so Im assuming that I get the full allowance. Right?

    Im trying to figure what else Id get for taxes...but I dont think id qualify as Im home nightly for the most part. I dont think meals or other munchies I buy qualify for anything.

    The IRS allows a half-day for the day you leave and half-day for the day you return.

    I take the full deduction for each day of travel. Just my opinion.

    Ok that makes some more sense as I have heard on XM about taking deductions for each day gone pretty much. However, they never have mentioned half days. A guy will call in and say he leaves Monday and comes back friday and the pro on the air says to take five days of allowances...the day he leaves, the day he comes back, and the days he is gone.

    I think that otherwise though, I can't take per diem stuff as Im a regular dedicated driver home daily...unless I get stuck in the weather and then I can take the per diem.

    I trust my opinion more than those on the radio. I been professionally preparing returns since 1982.
